459.0052, F.S.; prohibiting the department from

registration for medical residency or licensure under

8

certain circumstances; providing an exception; providing

9

an effective date.

Be It Enacted by the Legislature of the State of Florida:

12

     Section 1.  Section 458.3096, Florida Statutes, is created

14

to read:

15

     458.3096 Prohibition of medical residency or licensure in

16

the state; grounds for prohibition; exception.--

17

     (1) The department shall not register a person under s.

18

458.345 who is a United States citizen or United States resident

19

who has traveled to Cuba to receive medical training or a medical

20

degree. In addition, the department shall not issue a license

21

under this chapter to any United States citizen or United States

22

resident who has traveled to Cuba to receive medical training or

23

a medical degree.

     (2) This prohibition does not apply to any native or

25

citizen of Cuba who received his or her medical training or

26

medical degree in Cuba prior to immigrating to the United States.

     Section 2.  Section 459.0052, Florida Statutes, is created

28

to read:

     459.0052 Prohibition of medical residency or licensure in

30

the state; grounds for prohibition; exception.--

     (1) The department shall not register a person under s.

459.021 who is a United States citizen or United States resident

33

who has traveled to Cuba to receive medical training or a medical

34

degree. In addition, the department shall not issue a license

35

under this chapter to any United States citizen or United States

36

resident who has traveled to Cuba to receive medical training or

37

a medical degree.

     (2) This prohibition does not apply to any native or

39

citizen of Cuba who received his or her medical training or

40

medical degree in Cuba prior to immigrating to the United States.

41

     Section 3.  This act shall take effect July 1, 2008.
