An act relating to the Key Largo Wastewater Treatment

District, Monroe County; amending chapter 2002-337, Laws

4

of Florida; providing that the district is not subject to

5

local regulations governing discharge of effluent, is not

6

obligated to obtain licenses, permits, or authorizations

7

required by state and local regulating agencies, and is

8

not subject to supervision, regulation, or other power of

9

any state agency with respect to rate setting; providing

10

an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Subsection (6) is added to section 3 of section

15

1 of chapter 2002-337, Laws of Florida, to read:

16

     Section 3.  District; creation, jurisdiction, and purpose.--

17

     (6) The district shall comply with federal and state laws

18

governing the quality and manner of discharge of effluent but

19

shall not be subject to local regulation over the quality and

20

manner of discharge except as provided herein or to the extent

21

that the district may by agreement with any other public or

22

private body authorize the same to exercise over the projects of

23

the district. The district shall not be obligated to obtain

24

licenses, permits, or other authorizations required by state and

25

local regulating agencies for development but shall comply with

26

the substantive regulations, other than permitting, of the

27

appropriate agency in effect at the time of district approval of

28

the final plans for development. The district shall not be

29

subject to supervision, regulation, or other power of any bureau,

30

board, commission, or other agency of the state or any political

31

subdivision thereof with respect to rate setting.

     Section 2.  This act shall take effect upon becoming a law.
