An act relating to Broward County; amending chapter 98-

521, Laws of Florida; revising membership of the South

4

Broward Utility Advisory Board to provide for appointment

5

of members by the Town of Southwest Ranches rather than

6

the Broward County Commission; providing an effective

7

date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Section 1 of chapter 98-521, Laws of Florida, is

12

amended to read:

13

     Section 1.  There is hereby created the South Broward

14

Utility Advisory Board, which shall be an advisory board of the

15

City of Sunrise. The board shall be composed of seven members, as

16

follows: two members shall be appointed by the City of Sunrise,

17

two members shall be appointed by the Town of Davie, one member

18

shall be appointed by the City of Pembroke Pines, and two members

19

shall be appointed by the Town of Southwest Ranches Broward

20

County Commission. Each appointed member shall be a water and

21

sewer user within the service area of the former South Broward

22

Utility. Terms of each member shall be for 2 years, except that

23

all appointments and retention of board members shall be at the

24

sole discretion of the appointing authorities.

     (1)  The responsibility of the board shall be to review and

26

advise the City of Sunrise regarding any proposed change by the

27

city to the water and sewer rates charged within the area which

28

was formerly the South Broward Utility service area. In the event

29

of a proposed rate change within such area, the South Broward

30

Utility Advisory Board may require the City of Sunrise to hire a

31

rate consultant to advise the city regarding such proposed rate

32

change.

     (2)  Within 30 days following notice of a rate change, the

34

advisory board shall present a report of its findings to the

35

Commission of the City of Sunrise. If presented within the 30-day

36

period, the report shall be considered by the commission before

37

rates may be altered or changed within the area formerly served

38

by the South Broward Utility.

     (3)  The City of Sunrise shall appropriate not more than

40

$25,000 annually for a rate consultant for the South Broward

41

Utility Advisory Board, as provided in subsection (1).

     (4)  The advisory board shall have no legal standing to

43

bring any legal action.

     (5)  The City of Sunrise shall, by ordinance, provide for

45

such other procedures and regulations which are not in conflict

46

with this act as are necessary for the continued operation of the

47

board.

     Section 2.  This act shall take effect upon becoming a law.
