A bill to be entitled
2An act relating to recycling; amending s. 403.7145, F.S.;
3requiring each organization, association, business, and
4institution operating in the state and receiving state
5funds, and each public airport in the state, to collect
6aluminum beverage cans and recyclable plastic and glass
7from its place of business, or from the entities doing
8business at the airport, and to offer such materials for
9recycling; providing legislative intent; encouraging
10public school districts to recycle certain materials;
11providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Section 403.7145, Florida Statutes, is amended
16to read:
17     403.7145  Recycling.--
18     (1)  The Capitol and the House and Senate office buildings
19constitute the Capitol recycling area. The Florida House of
20Representatives, the Florida Senate, and the Office of the
21Governor, the Secretary of State, and each Cabinet officer who
22heads a department that occupies office space in the Capitol,
23shall institute a recycling program for their respective offices
24in the House and Senate office buildings and the Capitol.
25Provisions shall be made to collect and sell wastepaper and
26empty aluminum beverage cans generated by employee activities in
27these offices. The collection and sale of such materials shall
28be coordinated with Department of Management Services recycling
29activities to maximize the efficiency and economy of this
30program. The Governor, the Speaker of the House of
31Representatives, the President of the Senate, the Secretary of
32State, and the Cabinet officers may authorize the use of
33proceeds from recyclable material sales for employee benefits
34and other purposes, in order to provide incentives to their
35respective employees for participation in the recycling program.
36Such proceeds may also be used to offset any costs of the
37recycling program.
38     (2)  Each state agency, the judicial branch of state
39government, and the State University System shall collect and
40sell, to the greatest extent practicable, aluminum, glass, and
41plastic beverage containers, and other recyclable materials and
42products used during the operation of facilities and offices and
43may use the proceeds of the sale of such materials and products
44for employee benefits and other purposes and thereby provide
45incentives for employees to participate in the recycling
46program. Such proceeds may also be used to offset any recycling
47program costs.
48     (3)  Each organization, association, business, or
49institution operating in the state and receiving state funds
50shall, to the greatest extent practicable, collect aluminum
51beverage cans and recyclable plastic and glass at all locations
52where the organization, association, business, or institution
53operates or does business, and shall offer such materials for
54recycling. Each organization, association, business, or
55institution may retain and use any proceeds received from the
56sale of these materials for recycling to offset the cost
57associated with collecting and recycling such materials.
58     (4)  Each public airport operating in this state shall, to
59the greatest extent practicable, collect aluminum beverage cans
60and recyclable plastic and glass from the airlines and other
61entities doing business at the airport and offer such materials
62for recycling. Each airport may retain and use any proceeds
63received from the sale of these materials for recycling to
64offset the costs associated with collecting and recycling such
65materials. Airport administration offices, airport vendors, and
66airlines are encouraged to coordinate the collection of
67recyclable waste to the greatest extent practicable. The
68provisions of this subsection are not intended to interfere with
69any already established recycling activity.
70     (5)  Public school districts are encouraged to conduct
71recycling programs to the extent practicable and may substitute
72paper recycling for the materials stated above. It is not the
73intent of Legislature to have state dollars spent by public
74school districts on recycling programs that cost more to
75implement and operate than the amount recouped from the proceeds
76of the sale of recycled materials.
77     Section 2.  This act shall take effect July 1, 2008.
