2 | An act relating to recycling; amending s. 403.7145, F.S.; |
3 | requiring each organization, association, business, and |
4 | institution operating in the state and receiving state |
5 | funds, and each public airport in the state, to collect |
6 | aluminum beverage cans and recyclable plastic and glass |
7 | from its place of business, or from the entities doing |
8 | business at the airport, and to offer such materials for |
9 | recycling; providing legislative intent; encouraging |
10 | public school districts to recycle certain materials; |
11 | providing an effective date. |

13 | Be It Enacted by the Legislature of the State of Florida: |
14 |

15 | Section 1. Section 403.7145, Florida Statutes, is amended |
16 | to read: |
17 | 403.7145 Recycling.-- |
18 | (1) The Capitol and the House and Senate office buildings |
19 | constitute the Capitol recycling area. The Florida House of |
20 | Representatives, the Florida Senate, and the Office of the |
21 | Governor, the Secretary of State, and each Cabinet officer who |
22 | heads a department that occupies office space in the Capitol, |
23 | shall institute a recycling program for their respective offices |
24 | in the House and Senate office buildings and the Capitol. |
25 | Provisions shall be made to collect and sell wastepaper and |
26 | empty aluminum beverage cans generated by employee activities in |
27 | these offices. The collection and sale of such materials shall |
28 | be coordinated with Department of Management Services recycling |
29 | activities to maximize the efficiency and economy of this |
30 | program. The Governor, the Speaker of the House of |
31 | Representatives, the President of the Senate, the Secretary of |
32 | State, and the Cabinet officers may authorize the use of |
33 | proceeds from recyclable material sales for employee benefits |
34 | and other purposes, in order to provide incentives to their |
35 | respective employees for participation in the recycling program. |
36 | Such proceeds may also be used to offset any costs of the |
37 | recycling program. |
38 | (2) Each state agency, the judicial branch of state |
39 | government, and the State University System shall collect and |
40 | sell, to the greatest extent practicable, aluminum, glass, and |
41 | plastic beverage containers, and other recyclable materials and |
42 | products used during the operation of facilities and offices and |
43 | may use the proceeds of the sale of such materials and products |
44 | for employee benefits and other purposes and thereby provide |
45 | incentives for employees to participate in the recycling |
46 | program. Such proceeds may also be used to offset any recycling |
47 | program costs. |
48 | (3) Each organization, association, business, or |
49 | institution operating in the state and receiving state funds |
50 | shall, to the greatest extent practicable, collect aluminum |
51 | beverage cans and recyclable plastic and glass at all locations |
52 | where the organization, association, business, or institution |
53 | operates or does business, and shall offer such materials for |
54 | recycling. Each organization, association, business, or |
55 | institution may retain and use any proceeds received from the |
56 | sale of these materials for recycling to offset the cost |
57 | associated with collecting and recycling such materials. |
58 | (4) Each public airport operating in this state shall, to |
59 | the greatest extent practicable, collect aluminum beverage cans |
60 | and recyclable plastic and glass from the airlines and other |
61 | entities doing business at the airport and offer such materials |
62 | for recycling. Each airport may retain and use any proceeds |
63 | received from the sale of these materials for recycling to |
64 | offset the costs associated with collecting and recycling such |
65 | materials. Airport administration offices, airport vendors, and |
66 | airlines are encouraged to coordinate the collection of |
67 | recyclable waste to the greatest extent practicable. The |
68 | provisions of this subsection are not intended to interfere with |
69 | any already established recycling activity. |
70 | (5) Public school districts are encouraged to conduct |
71 | recycling programs to the extent practicable and may substitute |
72 | paper recycling for the materials stated above. It is not the |
73 | intent of Legislature to have state dollars spent by public |
74 | school districts on recycling programs that cost more to |
75 | implement and operate than the amount recouped from the proceeds |
76 | of the sale of recycled materials. |
77 | Section 2. This act shall take effect July 1, 2008. |
