A bill to be entitled
2An act relating to hate crimes; amending s. 775.085,
3F.S.; providing that intentional exposure of a victim to
4certain objects or symbols in the course of an offense
5creates a presumption that the offense evidences
6prejudice; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Paragraph (c) is added to subsection (1) of
11section 775.085, Florida Statutes, to read:
12     775.085  Evidencing prejudice while committing offense;
13reclassification.--

15     (c)  Intentional display of an object or symbol to a
16victim during the course of a felony or misdemeanor that the
17defendant knew or reasonably should have known would generally
18be understood by an ordinary person within the same class, as
19delineated in this section, as the victim to evidence a
20prejudice against or threat to persons of that class creates a
21presumption that the felony or misdemeanor evidences prejudice
22for purposes of this section.
23     Section 2.  This act shall take effect October 1, 2008.
