A bill to be entitled

An act relating to governmental procurement of biofuels;

3

establishing standards for the purchase of biodiesel

4

diesel fuel for use in state-owned diesel vehicles and

5

equipment; establishing standards for the purchase of

6

ethanol for use in state-owned flex-fuel vehicles;

7

providing for administration by the Department of

8

Management Services; requiring that the department

9

annually report to the Legislature the extent of biodiesel

10

and ethanol use in state-owned vehicles; establishing

11

standards for the purchase of biodiesel fuel by school

12

district transportation services; providing an effective

13

date.

Be It Enacted by the Legislature of the State of Florida:

16

     Section 1. State fleet biodiesel usage.--

18

     (1) By July 1, 2009, a minimum of 5 percent, by January 1,

19

2010, a minimum of 10 percent, and by January 1, 2011, a minimum

20

of 20 percent of total diesel fuel purchases for use in state-

21

owned diesel vehicles and equipment shall be biodiesel fuel

22

(B20), subject to availability.

     (2) By July 1, 2009, a minimum of 5 percent, by January 1,

24

2010, a minimum of 10 percent, and by January 1, 2011, a minimum

25

of 20 percent of total fuel purchases for use by state-owned

26

flex-fuel vehicles shall be ethanol, subject to availability.

27

     (3) The Department of Management Services shall administer

28

this section.

     (4) The Department of Management Services shall report to

30

the Legislature on or before March 1, 2009, and annually

31

thereafter, the extent of biodiesel and ethanol use in the state

32

fleet. The report must contain the number of gallons purchased

33

since July 1, 2008, the average price of biodiesel and ethanol,

34

and a description of fleet performance.

     Section 2. School district biodiesel usage.--

36

     (1) By January 1, 2009, a minimum of 20 percent of total

37

diesel fuel purchases for use by school districts shall be

38

biodiesel fuel (B20), subject to availability.

39

     (2) If a school district contracts with another government

40

entity or private entity to provide transportation services for

41

any of its pupils, the biodiesel fuel requirement established

42

under subsection (1) shall be part of that contract. However,

43

this requirement applies only to contracts entered into on or

44

after July 1, 2008.

     Section 3.  This act shall take effect July 1, 2008.
