Appropriations (Webster) recommended the following amendment:

     Senate Amendment (with title amendment)

     Between lines 8 and 9,

insert:

     Section 1.  Subsection (8) is added to section 99.012,

8

Florida Statutes, to read:

     99.012  Restrictions on individuals qualifying for public

10

office.--

11

     (8) A law enforcement officer is not required to resign his

12

or her law enforcement office upon qualifying as a candidate for

13

public office or election to public office unless the officer is

14

seeking a public office currently held by an officer who has

15

authority to appoint, employ, promote, or otherwise supervise

16

that person and who has qualified as a candidate for reelection

17

to that office. This chapter does not prohibit a subordinate

18

officer, deputy sheriff, or police officer from being reinstated

19

to duty if he or she is unsuccessful in seeking public office.

     On line 2, after the semicolon,

insert:

amending s. 99.012, F.S.; authorizing a law enforcement

26

officer to qualify as a candidate for public office

27

without resigning his or her law enforcement office;

providing an exception; providing for reinstatement to the

29

law enforcement office;
