An act relating to online safety; defining terms;

requiring an online dating service provider to notify a

Florida member that the online dating service has a safety

page containing the service's safety awareness

notification; requiring the online dating service to have

7

a link on its home page directing the Florida member to

8

the safety awareness notification; providing an effective

9

date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. Online safety.--

14

     (1) As used in this section, the term:

15

     (a) "Florida Member" means a person who submits to an

16

online dating service provider the information required by the

17

provider to access the provider's service for the purpose of

18

engaging in dating and participating in compatibility evaluations

19

with other persons or obtaining matrimonial matching services and

20

who provides a Florida billing address or zip code when

21

registering with the provider.

     (b) "Online dating service provider" or "provider" means a

23

person engaged in the business of offering or providing to its

24

members access to dating and compatibility evaluations between

25

persons or matrimonial matching services through the Internet.

     (2) An online dating service provider offering services to

27

Florida members shall provide a safety awareness notification

28

containing, at a minimum, information that includes a list and

29

description of safety measures reasonably designed to increase

30

awareness of safer dating practices as determined by the

31

provider.

     (3) An online dating service provider shall clearly and

33

conspicuously display on its home page a link directing the

34

Florida member to the safety awareness notification page.

     Section 2.  This act shall take effect July 1, 2008.
