12 | Be It Enacted by the Legislature of the State of Florida: |
13 |
|
14 | Section 1. Paragraphs (mmm), (nnn), (ooo), (ppp), and |
15 | (qqq) are added to subsection (4) of section 320.08056, Florida |
16 | Statutes, to read: |
17 | 320.08056 Specialty license plates.-- |
18 | (4) The following license plate annual use fees shall be |
19 | collected for the appropriate specialty license plates: |
20 | (mmm) Florida Tennis license plate, $25. |
21 | (nnn) Lighthouse Association license plate, $25. |
22 | (ooo) I Believe license plate, $25. |
23 | (ppp) In God We Trust license plate, $25. |
24 | (qqq) Horse Country license plate, $25. |
25 | Section 2. Subsections (65), (66), (67), (68), and (69) |
26 | are added to section 320.08058, Florida Statutes, to read: |
27 | 320.08058 Specialty license plates.-- |
28 | (65) FLORIDA TENNIS LICENSE PLATES.-- |
29 | (a) The department shall develop a Florida Tennis license |
30 | plate as provided in this section. The word "Florida" must |
31 | appear at the top of the plate, and the words "Play Tennis" must |
32 | appear at the bottom of the plate. The United States Tennis |
33 | Association Florida Section Foundation may submit a revised |
34 | sample plate for consideration by the department. |
35 | (b) The annual use fees shall be distributed to the |
36 | Florida Sports Foundation, a direct-support organization of the |
37 | Office of Tourism, Trade, and Economic Development. The license |
38 | plate annual use fees shall be annually allocated as follows: |
39 | 1. The United States Tennis Association Florida Section |
40 | shall receive the first $60,000 in proceeds from the annual use |
41 | fees to reimburse it for startup costs, administrative costs, |
42 | and other costs it incurs in the development and approval |
43 | process. |
44 | 2. Up to 5 percent of the proceeds from the annual use |
45 | fees may be used by the Florida Sports Foundation to administer |
46 | the license plate program. |
47 | 3. Up to 5 percent of the annual use fees may be used for |
48 | promoting and marketing the license plates. |
49 | 4. The remaining proceeds shall be made available by the |
50 | Florida Sports Foundation for grants awarded by the United |
51 | States Tennis Association Florida Section Foundation to benefit |
52 | nonprofit organizations to operate youth tennis programs and |
53 | adaptive tennis programs for special populations of all ages, |
54 | and for building, renovating, and maintaining public tennis |
55 | courts. |
56 | (66) LIGHTHOUSE LICENSE PLATES.-- |
57 | (a) The department shall develop a Lighthouse license |
58 | plate as provided in this section. The word "Florida" must |
59 | appear at the top of the plate, and the words "Visit Our Lights" |
60 | must appear at the bottom of the plate. |
61 | (b) The annual use fee shall be distributed to the Florida |
62 | Lighthouse Association, Inc., which may use a maximum of 10 |
63 | percent of the proceeds to promote and market the plate. The |
64 | remaining proceeds shall be used by the association to fund the |
65 | preservation, restoration, and protection of the 29 historic |
66 | lighthouses remaining in the state. |
67 | (67) I BELIEVE LICENSE PLATES.-- |
68 | (a) Notwithstanding s. 320.08053, the department shall |
69 | develop an I BELIEVE license plate as provided in this section. |
70 | I BELIEVE license plates must bear the colors and design |
71 | approved by the department. The word "Florida" must appear at |
72 | the top of the plate, and the words "I BELIEVE" must appear at |
73 | the bottom of the plate. |
74 | (b) The requirements of s. 320.08053 must be met prior to |
75 | the issuance of the plate. Thereafter, the license plate annual |
76 | use fees shall be distributed to Faith in Teaching, Inc., to |
77 | fund activities, programs, and projects that promote faith-based |
78 | education for youth within the state. Faith in Teaching, Inc., |
79 | may retain all revenue from the annual use fees until all |
80 | startup costs for developing and establishing the plate have |
81 | been recovered. Thereafter, up to 10 percent of the annual use |
82 | fee revenue may be used for administrative, promotional, and |
83 | marketing costs. |
84 | (68) IN GOD WE TRUST LICENSE PLATES.-- |
85 | (a) The department shall develop an In God We Trust |
86 | license plate as provided in this section. However, the |
87 | requirements of s. 320.08053 must be met before the plates are |
88 | issued. In God We Trust license plates must bear the colors and |
89 | design approved by the department. The word "Florida" must |
90 | appear at the top of the plate, and the words "In God We Trust" |
91 | must appear in the body of the plate. |
92 | (b) The license plate annual use fees shall be distributed |
93 | to the In God We Trust Foundation, Inc., to fund educational |
94 | scholarships for the children of Florida residents who are |
95 | members of the United States Armed Forces, the National Guard, |
96 | and the United States Armed Forces Reserve and for the children |
97 | of public safety employees who have died in the line of duty who |
98 | are not covered by existing state law. Funds shall also be |
99 | distributed to other 501(c)(3) organizations that may apply for |
100 | grants and scholarships and to provide educational grants to |
101 | public and private schools to promote the historical and |
102 | religious significance of American and Florida history. The In |
103 | God We Trust Foundation, Inc., shall distribute the license |
104 | plate annual use fees in the following manner: |
105 | 1. The In God We Trust Foundation, Inc., shall retain all |
106 | revenues from the sale of such plates until all startup costs |
107 | for developing and establishing the plate have been recovered. |
108 | 2. Ten percent of the funds received by the In God We |
109 | Trust Foundation, Inc., shall be expended for administrative |
110 | costs, promotion, and marketing of the license plate directly |
111 | associated with the operations of the In God We Trust |
112 | Foundation, Inc. |
113 | 3. All remaining funds shall be expended by the In God We |
114 | Trust Foundation, Inc., for programs. |
115 | (69) HORSE COUNTRY LICENSE PLATES.-- |
116 | (a) Notwithstanding s. 320.08053, the department shall |
117 | develop a Horse Country license plate as provided in this |
118 | section. Horse Country license plates must bear the colors and |
119 | design approved by the department. The word "Florida" must |
120 | appear at the top of the plate, and the words "Horse Country" |
121 | must appear at the bottom of the plate. |
122 | (b) The requirements of s. 320.08053 must be met prior to |
123 | the issuance of the plate. Thereafter, the license plate annual |
124 | use fees shall be distributed to PCMI Properties, Inc., to fund |
125 | programs involved in the rehabilitation of at-risk youth as |
126 | directed by the Board of Trustees of PCMI Properties, Inc. Such |
127 | funds may be used to provide educational materials, athletic |
128 | equipment, transportation, food, medical services, counseling, |
129 | scholarships, and other direct administrative and program |
130 | expenses. The funds may also be used as grants for expansion of |
131 | youth rehabilitation programs in the state. Special |
132 | consideration shall be given to programs using horses and other |
133 | livestock in the efforts to redirect at-risk youth. PCMI |
134 | Properties, Inc., may retain all revenue from the annual use |
135 | fees until all startup costs for developing and establishing the |
136 | plate have been recovered. Thereafter, up to 10 percent of the |
137 | annual use fee revenue may be used for promotion and marketing |
138 | of the plate, and as necessary for annual audit or compliance |
139 | affidavit costs. |
140 | Section 3. This act shall take effect October 1, 2008. |
