Senator Bennett moved the following Senate amendment to House

Section 7. Subsection (3) of section 170.01, Florida
8
Statutes, is amended to read:
9
170.01 Authority for providing improvements and levying and
10
collecting special assessments against property benefited.--
11
(3)(a) Any municipality, subject to the approval of a
12
majority of the affected property owners, may levy and collect
13
special assessments against property benefited for the purpose of
14
stabilizing and improving:
15
1.(a) Retail business districts,
16
2.(b) Wholesale business districts, or
17
3.(c) Nationally recognized historic districts,
18
19
or any combination of such districts, through promotion,
20
management, marketing, and other similar services in such
21
districts of the municipality. This subsection does not authorize
22
a municipality to use bond proceeds to fund ongoing operations of
23
these districts.

(b) Any municipality may determine, in any resolution
25
required by s. 170.03 to declare special assessments, that the
26
vote of affected property owners shall be conducted by voting by
27
tax folio numbers of affected properties or by total square
28
footage of the affected properties.

Section 8. Subsection (1) of section 189.403, Florida
30
Statutes, is amended to read:

189.403 Definitions.--As used in this chapter, the term:
32
(1) "Special district" means a local unit of special
33
purpose, as opposed to general-purpose, government within a
34
limited boundary, created by general law, special act, local
35
ordinance, or by rule of the Governor and Cabinet. The special
36
purpose or purposes of special districts are implemented by
37
specialized functions and related prescribed powers. For the
38
purpose of ss. s. 196.199(1) and 282.104, special districts shall
39
be treated as municipalities. The term does not include a school
40
district, a community college district, a special improvement
41
district created pursuant to s. 285.17, a municipal service
42
taxing or benefit unit as specified in s. 125.01, or a board
43
which provides electrical service and which is a political
44
subdivision of a municipality or is part of a municipality.

Section 9. Effective July 1, 2008, section 189.414, Florida
46
Statutes, is created to read:
47
189.414 Purchases under purchasing agreements of special
48
districts, municipalities, or counties.--Each special district
49
may purchase commodities and contractual services under the
50
purchasing agreement of other special districts, municipalities,
51
or counties if such agreement was procured on or after July 1,
52
2008, pursuant to competitive bid, requests for proposals, or
53
requests for qualifications; was procured by a process that would
54
have met the procurement requirements of the purchasing special
55
district; and otherwise complies with general law.
