An act relating to expedited permitting process for

economic development projects; providing a short title;

creating s. 380.0657, F.S.; requiring the Department of

5

Environmental Protection and water management districts to

6

adopt programs to expedite the processing of permits for

7

certain economic development projects; requiring

8

municipalities and counties to identify certain businesses

9

by commission resolution; providing a timeframe for permit

10

application approval or denial; providing an effective

11

date.

Be It Enacted by the Legislature of the State of Florida:

14

     Section 1. This act may be cited as the "Mike McHugh Act."

16

     Section 2.  Section 380.0657, Florida Statutes, is created

17

to read:

     380.0657 Expedited permitting process for economic

19

development projects.--The Department of Environmental Protection

20

and, as appropriate, the water management districts created under

21

chapter 373 shall adopt programs to expedite the processing of

22

wetland resource and environmental resource permits for economic

23

development projects that have been identified by a municipality

24

or county as meeting the definition of target industry businesses

25

under s. 288.106. A municipality or county shall provide an

26

identified business with a city or county commission resolution

27

identifying the business as a targeted industry business for the

28

purposes of this section. Permit applications pursuant to this

29

section shall be approved or denied within 30 days after receipt

30

of the original application, the last item of timely requested

31

additional material, or the applicant's written request to begin

32

processing the permit application.

     Section 3.  This act shall take effect July 1, 2008.
