An act relating to trust funds; creating the Florida

Alternative Energy Center Trust Fund; providing for

4

sources of funds and purposes; requiring funds to remain

5

in the trust fund at the end of each fiscal year;

6

providing for future review and termination or re-creation

7

of the fund; providing a contingent effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. (1) The Florida Alternative Energy Center Trust

12

Fund is created within, and shall be administered by, the Office

13

of Tourism, Trade, and Economic Development. Moneys deposited

14

into the fund shall be those collected from sources designated by

15

law, federal moneys made available for alternative energy uses,

16

donations, or moneys appropriated from the General Revenue Fund.

The purpose of the trust fund is to provide funding for the

18

Florida Alternative Energy Center in fulfilling its statutory

19

duties.

     (2) Notwithstanding s. 216.301, Florida Statutes, and under

21

s. 216.351, Florida Statutes, any balance in the trust fund at

22

the end of any fiscal year shall remain in the trust fund at the

23

end of the fiscal year and shall be available for carrying out

24

the purposes of the trust fund.

     (3) In accordance with Section 19(f)(2), Article III of the

26

State Constitution, the trust fund must, unless terminated

27

sooner, be terminated on July 1, 2012. Before its scheduled

28

termination, the trust fund must be reviewed as provided in s.

29

215.3206(1) and (2), Florida Statutes.

     Section 2.  This act shall take effect on the same date as

31

SB ___ or similar legislation takes effect, if such legislation

32

is enacted in the same legislative session, or an extension

33

thereof, and becomes law, but this act shall not take effect

34

unless it is enacted by a three-fifths vote of the membership of

35

each house of the Legislature.
