A bill to be entitled
2An act relating to failure to redeliver hired vehicles;
3amending s. 817.52, F.S.; providing that information not
4required by a specified provision shall not be required in
5order to report the failure to redeliver a hired vehicle
6in violation of that provision; requiring the entry of
7reports of such failures in specified reporting systems;
8providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Subsection (3) of section 817.52, Florida
13Statutes, is amended to read:
14     817.52  Obtaining vehicles with the intent to defraud,
15failing to return hired vehicle, or tampering with mileage
16device of hired vehicle.--
17     (3)  FAILURE TO REDELIVER HIRED VEHICLE.--Whoever, after
18hiring a motor vehicle under an agreement to redeliver the same
19to the person letting such motor vehicle or his or her agent, at
20the termination of the period for which it was let, shall,
21without the consent of such person or persons and with intent to
22defraud, abandon or willfully refuse to redeliver such vehicle
23as agreed commits shall, upon conviction, be guilty of a felony
24of the third degree, punishable as provided in s. 775.082, s.
25775.083, or s. 775.084. No law enforcement agency shall require
26information not required by this subsection to be supplied in
27order to accept a report of a violation of this subsection. A
28report accepted by a law enforcement agency under this
29subsection shall be entered into the National Crime Information
30Center and the Florida Crime Information Center systems listing
31the hired vehicle as a stolen vehicle.
32     Section 2.  This act shall take effect July 1, 2008.
