| 1 | A bill to be entitled |
| 2 | An act relating to failure to redeliver hired vehicles; |
| 3 | amending s. 817.52, F.S.; providing that information not |
| 4 | required by a specified provision shall not be required in |
| 5 | order to report the failure to redeliver a hired vehicle |
| 6 | in violation of that provision; requiring the entry of |
| 7 | reports of such failures in specified reporting systems; |
| 8 | providing an effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. Subsection (3) of section 817.52, Florida |
| 13 | Statutes, is amended to read: |
| 14 | 817.52 Obtaining vehicles with the intent to defraud, |
| 15 | failing to return hired vehicle, or tampering with mileage |
| 16 | device of hired vehicle.-- |
| 17 | (3) FAILURE TO REDELIVER HIRED VEHICLE.--Whoever, after |
| 18 | hiring a motor vehicle under an agreement to redeliver the same |
| 19 | to the person letting such motor vehicle or his or her agent, at |
| 20 | the termination of the period for which it was let, shall, |
| 21 | without the consent of such person or persons and with intent to |
| 22 | defraud, abandon or willfully refuse to redeliver such vehicle |
| 23 | as agreed commits shall, upon conviction, be guilty of a felony |
| 24 | of the third degree, punishable as provided in s. 775.082, s. |
| 25 | 775.083, or s. 775.084. No law enforcement agency shall require |
| 26 | information not required by this subsection to be supplied in |
| 27 | order to accept a report of a violation of this subsection. A |
| 28 | report accepted by a law enforcement agency under this |
| 29 | subsection shall be entered into the National Crime Information |
| 30 | Center and the Florida Crime Information Center systems listing |
| 31 | the hired vehicle as a stolen vehicle. |
| 32 | Section 2. This act shall take effect July 1, 2008. |
