3     Amendment (with title amendment)
4     Remove lines 188-220 and insert:
5     Section 3.  Section 775.0846, Florida Statutes, is amended
6to read:
7     775.0846  Possession of Wearing bulletproof vest while
8committing certain offenses.--
9     (1)  As used in For the purposes of this section, the term
10"bulletproof vest" means a bullet-resistant soft body armor
11providing, as a minimum standard, the level of protection known
12as "threat level I," which shall mean at least seven layers of
13bullet-resistant material providing protection from three shots
14of 158-grain lead ammunition fired from a .38 caliber handgun at
15a velocity of 850 feet per second.
16     (2)  No A person may possess is guilty of the unlawful
17wearing of a bulletproof vest while when, acting alone or with
18one or more other persons and while possessing a firearm, he or
19she commits or attempts to commit any murder, sexual battery,
20robbery, burglary, arson, aggravated assault, aggravated
21battery, kidnapping, escape, breaking and entering with intent
22to commit a felony, criminal gang-related offense under chapter
23874, controlled substance offense under chapter 893, or aircraft
24piracy and such possession is, in the course of and in
25furtherance of any such crime, he or she wears a bulletproof
26vest.
27     (3)  Any person who violates is convicted of a violation of
28this section commits is guilty of a felony of the third degree,
29punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

33     Remove lines 6-8 and insert:
