     Section 1.  Subsection (8) of section 311.12, Florida

9

Statutes, is amended to read:

10

     311.12  Seaport security standards; inspections;

11

compliance; appeals.--

12

     (8)(a)  The Seaport Security Standards Advisory Council is

13

created under the Office of Drug Control. The council shall

14

serve as an advisory council under s. 20.03(7).

15

     (b)1.  The members of the Seaport Security Standards

16

Advisory Council shall be appointed by the Governor and consist

17

of the following:

18

     a.  Two seaport directors.

19

     b.  Two seaport security directors.

20

     c.  One designee from the Department of Law Enforcement.

21

     d.  One designee from the Office of Motor Carrier

22

Compliance of the Department of Transportation.

23

     e.  One designee from the Attorney General's Office.

24

     f.  One designee from the Department of Agriculture and

25

Consumer Services.

26

     g.  One designee from the Office of Tourism, Trade, and

27

Economic Development.

28

     h.  One designee from the Office of Drug Control.

29

     i. Two designees representing seaport tenants, one each

30

from two of the state's 14 deepwater ports.

31

     j. Two designees representing seaport workers, one each

32

from two of the state's 14 deepwater ports.

     2.  In addition to the members designated in subparagraph

34

1., the council shall may invite a representative of the United

35

States Coast Guard to attend and participate in council meetings

36

as an ex officio, nonvoting member of the council.

37

     (c)  Members of the council shall serve for terms of 4

38

years. A vacancy shall be filled by the original appointing

39

authority for the balance of the unexpired term.

40

     (d)  The Seaport Security Standards Advisory Council shall

41

be chaired by a designee from the Office of Drug Control. The

42

council shall meet upon the call of the chair and at least once

43

every 5 years.

     (e)  Commencing on January 15, 2007, and at least every 4

45

years thereafter, the Office of Drug Control shall convene the

46

Seaport Security Standards Advisory Council to review the

47

statewide minimum standards. The Seaport Security Standards

48

Advisory Council shall review the statewide minimum standards

49

for seaport security for applicability to and effectiveness in

50

combating current narcotics and terrorism threats to Florida's

51

seaports. All sources of information allowed by law shall be

52

utilized in assessing the applicability and effectiveness of the

53

standards.

     (f) The Office of Drug Control shall convene a meeting the

55

Seaport Security Standards Advisory Council at least annually in

56

order to consult with the appropriate area maritime security

57

committees, the Florida Seaport Transportation and Economic

58

Development Council, port tenants, and other affected parties,

59

and to assess actual and possible impacts of seaport security on

60

commerce and trade. The council shall also make recommendations

61

to promote the flow of legitimate trade and travel through the

62

state's seaports.

     (g)(f) Seaport Security Standards Advisory Council members

64

shall serve without pay; however, per diem and travel allowances

65

may be claimed for attendance of officially called meetings as

66

provided by s. 112.061.

     (g) The Seaport Security Standards Advisory Council shall

68

consult with the appropriate area maritime security committees

69

to assess possible impacts to commerce and trade contained in

70

the council's nonclassified recommendations and findings.

71

     (h)  Recommendations and findings of the council shall be

72

transmitted to the Governor, the Speaker of the House of

73

Representatives, and the President of the Senate.

     Section 2.  This act shall take effect July 1, 2008.
