Section 1. Paragraph (b) of subsection (8) of section

311.12, Florida Statutes, is amended to read:

(b)1. The members of the Seaport Security Standards
13
Advisory Council shall be appointed by the Governor and consist
14
of the following:
15
a. Two seaport directors.
16
b. Two seaport security directors.
17
c. One designee from the Department of Law Enforcement.
18
d. One designee from the Office of Motor Carrier Compliance
19
of the Department of Transportation.
20
e. One designee from the Attorney General's Office.
21
f. One designee from the Department of Agriculture and
22
Consumer Services.

g. One designee from the Office of Tourism, Trade, and
24
Economic Development.
25
h. One designee from the Office of Drug Control.
26
i. Two designees from an organization that represents the
27
tenants of the seaports listed in s. 311.09(1).
28
j. Two designees from a labor organization, as defined in
29
s.447.02, which represents seaport workers at the seaports listed
30
in s. 311.09(1).

k. One designee from the Division of Law Enforcement of the
32
Fish and Wildlife Conservation Commission.

l. Two designees of sheriffs who have law enforcement
34
responsibilities on the seaports listed in s. 311.09(1).

m. One designee of a police chief who has law enforcement
36
responsibilities on the seaports listed in s. 311.09(1).

2. In addition to the members designated in subparagraph
38
1., the council may invite a representative of the United States
39
Coast Guard to attend and participate in council meetings as an
40
ex officio, nonvoting member of the council.

Section 2. Subsection (1) of section 311.09, Florida
42
Statutes, is amended, and subsection (13) is added to that
43
section, to read:

311.09 Florida Seaport Transportation and Economic
45
Development Council.--
46
(1) The Florida Seaport Transportation and Economic
47
Development Council is created within the Department of
48
Transportation. The council consists of the following 19 17
49
members: the port director, or the port director's designee, of
50
each of the ports of Jacksonville, Port Canaveral, Fort Pierce,
51
Palm Beach, Port Everglades, Miami, Port Manatee, St. Petersburg,
52
Tampa, Port St. Joe, Panama City, Pensacola, Key West, and
53
Fernandina; the secretary of the Department of Transportation or
54
his or her designee; the director of the Office of Tourism,
55
Trade, and Economic Development or his or her designee; and the
56
secretary of the Department of Community Affairs or his or her
57
designee; one designee from an organization that represents the
58
tenants of the state's seaports listed in s. 311.09(1); and one
59
designee from a labor organization, as defined in s. 447.02,
60
representing seaport workers at the state's seaports listed in s.
61
311.09(1).

(13)(a) The council shall convene at least one meeting
63
annually in order to consult with the appropriate maritime
64
security committees, the Seaport Security Standards Advisory
65
Council, the Department of Law Enforcement, port tenants, and
66
other affected parties, and to analyze and assess actual and
67
possible impacts of seaport security on commerce and trade.

(b) Pursuant to paragraph (a), the council shall consider
69
in its analysis the cost of security on the seaports listed in
70
this section. Such analysis shall include, but need not be
71
limited to, the impact of seaport security on seaport operational
72
and capital costs that are the result of requirements enacted by
73
federal law individually, state law individually, and a
74
combination of both federal and state law and shall exclude costs
75
related to the routine business and safety operations of a port;
76
the impact of seaport security costs on the ability of the
77
seaports to fund enhanced commercial operations; the economic
78
impact resulting from actual and potential criminal activity
79
associated with seaport operations, including cargo theft, human
80
trafficking, and the smuggling of illegal drugs through the
81
public seaports; and the economic impact, including tax revenue
82
loss, to the state of a successful terrorism event at a seaport
83
covered under this section.

(c) The council shall make recommendations to promote the
85
flow of legitimate trade and travel through the state's seaports
86
and report its analysis and recommendations to the President of
87
the Senate and the Speaker of the House of Representatives
88
annually.

Section 3. This act shall take effect July 1, 2008.
