A bill to be entitled
2An act relating to resolution of public employee
3collective bargaining impasses; amending s. 447.203, F.S.;
4specifying legislative body when public employer is the
5sheriff; amending s. 447.403, F.S.; delineating role of
6sheriff in declaring an impasse and in impasse
7proceedings; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Subsection (10) of section 447.203, Florida
12Statutes, is amended to read:
13     447.203  Definitions.--As used in this part:
14     (10)  "Legislative body" means the State Legislature, the
15board of county commissioners, the district school board, the
16governing body of a municipality, or the governing body of an
17instrumentality or unit of government having authority to
18appropriate funds and establish policy governing the terms and
19conditions of employment and which, as the case may be, is the
20appropriate legislative body for the bargaining unit. For
21purposes of s. 447.403, the Board of Governors of the State
22University System, or the board's designee, shall be deemed to
23be the legislative body with respect to all employees of each
24constituent state university. For purposes of s. 447.403 the
25board of trustees of a community college shall be deemed to be
26the legislative body with respect to all employees of the
27community college. For the purposes of s. 447.403, if the public
28employer is the sheriff, the board of county commissioners of
29the county served by the sheriff shall be deemed to be the
30legislative body with respect to all employees of the sheriff.
31     Section 2.  Paragraph (d) is added to subsection (2) of
32section 447.403, Florida Statutes, to read:
33     447.403  Resolution of impasses.--
34     (2)
35     (d)  If the public employer is a sheriff, the sheriff shall
36not preside over any stage of the impasse proceedings. This does
37not preclude the sheriff, as the public employer, from declaring
38an impasse or from being a party to an impasse proceeding.
39     Section 3.  This act shall take effect July 1, 2008.
