3     Amendment (with title amendment)
4     Between lines 45 and 46, insert:
5     Section 2. Subsection (1) of section 27.25, Florida
6Statutes, is amended to read.
7     27.25  State attorney authorized to employ personnel;
8funding formula.--
9     (1) The state attorney of each judicial circuit is
10authorized to employ and establish, in such number as is
11authorized by the General Appropriations Act, assistant state
12attorneys and other staff pursuant to s. 29.005.  The state
13attorneys of all judicial circuits shall jointly develop a
14coordinated classification and pay plan which shall be submitted
15on or before January 1 of each year to the Justice
16Administrative Commission, the office of the President of the
17Senate, and the office of the Speaker of the House of
18Representatives. Notwithstanding s. 216.181(10)(b) or any other
19similar provision of law or rule governing the judicial,
20executive, or legislative branches, such plan shall be developed
21in accordance with policies and procedures of the Executive
22Office of the Governor established pursuant to s. 216.181. End
23of fiscal year lump-sum salary bonuses may be awarded by the
24state attorney from funds appropriated for salaries, with
25eligibility for such bonuses to be determined pursuant to the
26eligibility criteria in s. 110.1245(2)(b), F.S. Any state
27attorney that authorizes lump-sum salary bonuses shall report
28the payment of such bonuses, including the date, amount,
29recipient, and the reasons and justification for his or her
30decision to award such bonuses, quarterly to the Justice
31Administrative Commission, the office of the President of the
32Senate, and the office of the Speaker of the House of
33Representatives.

40     Remove line 10 and insert:
41by law; amending s. 27.25, F.S.; requiring that
42coordinated classification and pay plans for state
43attorneys in all judicial circuits be developed in
44accordance with s. 216.181, F.S., notwithstanding that
45lump-sum salary bonuses, or other similar provisions of
46law or rule relating to government officials, may be
47provided only if specifically appropriated or provided for
48by law; authorizing state attorneys to award lump-sum
49bonuses according to specified criteria; requiring
50reporting of payment of bonuses; providing an effective
51date.
