A bill to be entitled
2An act relating to trust funds; re-creating the Welfare
3Transition Trust Fund within the Department of Health
4without modification; carrying forward current balances
5and continuing current sources and uses thereof; amending
6s. 20.435, F.S.; removing the scheduled termination of the
7trust fund; providing an effective date.

9     WHEREAS, the Legislature wishes to extend the life of the
10Welfare Transition Trust Fund within the Department of Health,
11which is otherwise scheduled to be terminated pursuant to
12constitutional mandate, and
13     WHEREAS, the Legislature has reviewed the trust fund before
14its scheduled termination date and has found that it continues
15to meet an important public purpose, and
16     WHEREAS, the Legislature has found that existing public
17policy concerning the trust fund sets adequate parameters for
18its use, NOW, THEREFORE,

20Be It Enacted by the Legislature of the State of Florida:

22     Section 1.  (1)  The Welfare Transition Trust Fund within
23the Department of Health, FLAIR number 64-2-401, which is to be
24terminated pursuant to Section 19(f), Article III of the State
25Constitution on July 1, 2008, is re-created.
26     (2)  All current balances of the trust fund are carried
27forward, and all current sources and uses of the trust fund are
28continued.
29     Section 2.  Paragraph (i) of subsection (1) of section
3020.435, Florida Statutes, is amended to read:
31     20.435  Department of Health; trust funds.--
32     (1)  The following trust funds are hereby created, to be
33administered by the Department of Health:
34     (i)  Welfare Transition Trust Fund.
35     1.  The Welfare Transition Trust Fund is created within the
36Department of Health for the purposes of receiving federal funds
37under the Temporary Assistance for Needy Families Program. Trust
38fund moneys shall be used exclusively for the purpose of
39providing services to individuals eligible for Temporary
40Assistance for Needy Families pursuant to the requirements and
41limitations of part A of Title IV of the Social Security Act, as
42amended, or any other applicable federal requirement or
43limitation. Funds credited to the trust fund consist of those
44funds collected from the Temporary Assistance for Needy Families
45Block Grant.
46     2.  In accordance with s. 19(f)(2), Art. III of the State
47Constitution, the Welfare Transition Trust Fund shall be
48terminated on July 1, 2008, unless terminated sooner. Before its
49scheduled termination, the trust fund shall be reviewed as
50provided in s. 215.3206(1) and (2).
51     Section 3.  This act shall take effect July 1, 2008.
