     Section 3.  Section 322.093, Florida Statutes, is created to

8

read:

9

     322.093 Driver education for minors.--Notwithstanding any

10

other provision of law, the department may not issue a driver's

11

license to a person who has not attained 18 years of age unless

12

the person has successfully completed a driver education course

13

of instruction in the operation of motor vehicles given by a

14

public secondary school in compliance with s. 1003.48, a

15

nonpublic school meeting the standards prescribed under s.

16

1003.48, or a commercial driving school licensed under chapter

17

488. The school shall issue a certificate to each student who

18

successfully completes the driver education course.

19

     Section 4.  Section 1003.48, Florida Statutes, is amended to

20

read:

21

     1003.48  Instruction in operation of motor vehicles.--

22

     (1)  A course of study and instruction in the safe and

23

lawful operation of a motor vehicle shall be made available by

24

each district school board to students in the secondary schools

25

in the state. As used in this section, the term "motor vehicle"

26

shall have the same meaning as in s. 320.01(1)(a) and shall

27

include motorcycles and mopeds. The course must include classroom

28

instruction and behind-the-wheel training, except that

29

instruction in motorcycle or moped operation may be limited to

30

classroom instruction. The course shall not be made a part of, or

31

a substitute for, any of the minimum requirements for graduation.

32

     (2)  In order to make such a course available to any

33

secondary school student, the district school board may use any

34

one of the following procedures or any combination thereof:

35

     (a)  Utilize instructional personnel employed by the

36

district school board.

37

     (b)  Contract with a commercial driving school licensed

38

under the provisions of chapter 488.

39

     (c)  Contract with an instructor certified under the

40

provisions of chapter 488.

41

     (3)(a)  District school boards shall earn funds on full-time

42

equivalent students at the appropriate basic program cost factor,

43

regardless of the method by which such courses are offered.

44

     (b)  For the purpose of financing the Driver Education

45

Program in the secondary schools, there shall be levied an

46

additional 50 cents per year to the driver's license fee required

47

by s. 322.21. The additional fee shall be promptly remitted to

48

the Department of Highway Safety and Motor Vehicles, which shall

49

transmit the fee to the Chief Financial Officer to be deposited

50

in the General Revenue Fund.

     (c) A board of county commissioners may use funds received

52

pursuant to s. 318.1215 to supplement funds for driver education

53

courses in public and nonpublic schools as provided in s.

54

318.1215.

55

     (4) The Commissioner of Education district school board

56

shall prescribe standards for the course required by this section

57

and for instructional personnel directly employed by the district

58

school board. Any certified instructor or licensed commercial

59

driving school shall be deemed sufficiently qualified and shall

60

not be required to meet any standards in lieu of or in addition

61

to those prescribed under chapter 488.

enforcement; providing penalties; amending s. 322.27,

F.S.; providing for a point assessment against the

73

driver's license; creating s. 322.093, F.S.; requiring

74

that minors complete a driver education course prior to

75

issuance of a driver's license; providing that the course

76

may be given by a public secondary school, a nonpublic

77

school, or a commercial driving school meeting specified

78

requirements; requiring the school to issue a certificate

79

to a student who successfully completes the course;

80

amending s. 1003.48, F.S.; providing instruction and

81

training requirements for driver education courses;

82

authorizing a board of county commissioners to use certain

83

funds to supplement funds for driver education courses;

84

requiring that the Commissioner of Education rather than

85

the district school board prescribe standards concerning a

86

required driver education course or certain instructional

87

personnel employed by the board; providing an effective

88

date.
