3     Conference Committee Amendment (with title amendment)
4     Remove everything after the enacting clause and insert:
5     Section 1.  Subsection (17) of section 318.18, Florida
6Statutes, is amended to read:
7     318.18  Amount of penalties.--The penalties required for a
8noncriminal disposition pursuant to s. 318.14 or a criminal
9offense listed in s. 318.17 are as follows:
10     (17)  In addition to any penalties imposed, a surcharge of
11$3 must be paid for all criminal offenses listed in s. 318.17
12and for all noncriminal moving traffic violations under chapter
13316. Revenue from the surcharge shall be remitted to the
14Department of Revenue and deposited quarterly into the State
15Agency Law Enforcement Radio System Trust Fund of the Department
16of Management Services for the state agency law enforcement
17radio system, as described in s. 282.1095, and to provide
18technical assistance to state agencies and local law enforcement
19agencies with their statewide systems of regional law
20enforcement communications, as described in s. 282.111. This
21subsection expires July 1, 2012. The Department of Management
22Services may retain funds sufficient to recover the costs and
23expenses incurred for the purposes of managing, administering,
24and overseeing the Statewide Law Enforcement Radio System, and
25providing technical assistance to state agencies and local law
26enforcement agencies with their statewide systems of regional
27law enforcement communications. The Department of Management
28Services working in conjunction with the Joint Task Force on
29State Agency Law Enforcement Communications shall determine and
30direct the purposes for which these funds are used to enhance
31and improve the radio system.
32     Section 2.  This act shall take effect July 1, 2008.

44Agency Law Enforcement Radio System Trust Fund of the
45Department of Management Services, and be used for certain
46purposes; authorizing the Department of Management
47Services to retain funds from such revenue to recover
48certain costs and expenses; providing an effective date.
