A bill to be entitled
2An act relating to the State Agency Law Enforcement Radio
3System Trust Fund; amending s. 318.18, F.S.; revising
4purposes of the trust fund to include the provision of
5technical assistance to state agencies and local law
6enforcement agencies with their statewide system of
7regional law enforcement communications; clarifying that
8the Department of Management Services shall determine and
9direct the purposes for which funds are used; reenacting
10s. 318.21(17), F.S., relating to disposition of civil
11penalties by county courts, for the purpose of
12incorporating the amendment to s. 318.18, F.S., in a
13reference thereto; providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:

17     Section 1.  Subsection (17) of section 318.18, Florida
18Statutes, is amended to read:
19     318.18  Amount of penalties.--The penalties required for a
20noncriminal disposition pursuant to s. 318.14 or a criminal
21offense listed in s. 318.17 are as follows:
22     (17)  In addition to any penalties imposed, a surcharge of
23$3 must be paid for all criminal offenses listed in s. 318.17
24and for all noncriminal moving traffic violations under chapter
25316. Revenue from the surcharge shall be remitted to the
26Department of Revenue and deposited quarterly into the State
27Agency Law Enforcement Radio System Trust Fund of the Department
28of Management Services for the state agency law enforcement
29radio system, as described in s. 282.1095, and to provide
30technical assistance to state agencies and local law enforcement
31agencies with their statewide system of regional law enforcement
32communications, as described in s. 282.111. This subsection
33expires July 1, 2012. The Department of Management Services may
34retain funds sufficient to recover the costs and expenses
35incurred for the purposes of managing, administering, and
36overseeing the Statewide Law Enforcement Radio System and for
37the purpose of providing technical assistance to state agencies
38and local law enforcement agencies with their statewide system
39of regional law enforcement communications. The Department of
40Management Services working in conjunction with the Joint Task
41Force on State Agency Law Enforcement Communications may
42recommend to the Department of Management Services shall
43determine and direct the purposes for which these funds may be
44are used to enhance and improve the radio system. The Department
45of Management Services shall determine and direct the purposes
46for which these funds are used in accordance with this
47subsection.
48     Section 2.  For the purpose of incorporating the amendment
49made by this act to section 318.18, Florida Statutes, in a
50reference thereto, subsection (17) of section 318.21, Florida
51Statutes, is reenacted to read:
52     318.21  Disposition of civil penalties by county
53courts.--All civil penalties received by a county court pursuant
54to the provisions of this chapter shall be distributed and paid
55monthly as follows:
56     (17)  Notwithstanding subsections (1) and (2), the proceeds
57from the surcharge imposed under s. 318.18(17) shall be
58distributed as provided in that subsection. This subsection
59expires July 1, 2012.
60     Section 3.  This act shall take effect July 1, 2008.
