A bill to be entitled
2An act relating to the disposition of traffic infractions;
3amending s. 318.18, F.S.; requiring that revenue from the
4surcharge imposed for certain criminal traffic offenses
5and all noncriminal traffic violations be remitted to the
6Department of Revenue, deposited quarterly into the State
7Agency Law Enforcement Radio System Trust Fund of the
8Department of Management Services, and be used for certain
9purposes; authorizing the Department of Management
10Services to retain funds from such revenue to recover
11certain costs and expenses; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Subsection (17) of section 318.18, Florida
16Statutes, is amended to read:
17     318.18  Amount of penalties.--The penalties required for a
18noncriminal disposition pursuant to s. 318.14 or a criminal
19offense listed in s. 318.17 are as follows:
20     (17)  In addition to any penalties imposed, a surcharge of
21$3 must be paid for all criminal offenses listed in s. 318.17
22and for all noncriminal moving traffic violations under chapter
23316. Revenue from the surcharge shall be remitted to the
24Department of Revenue and deposited quarterly into the State
25Agency Law Enforcement Radio System Trust Fund of the Department
26of Management Services for the state agency law enforcement
27radio system, as described in s. 282.1095, and to provide
28technical assistance to state agencies and local law enforcement
29agencies with their statewide systems of regional law
30enforcement communications, as described in s. 282.111. This
31subsection expires July 1, 2012. The Department of Management
32Services may retain funds sufficient to recover the costs and
33expenses incurred for the purposes of managing, administering,
34and overseeing the Statewide Law Enforcement Radio System, and
35providing technical assistance to state agencies and local law
36enforcement agencies with their statewide systems of regional
37law enforcement communications. The Department of Management
38Services working in conjunction with the Joint Task Force on
39State Agency Law Enforcement Communications shall determine and
40direct the purposes for which these funds are used to enhance
41and improve the radio system.
42     Section 2.  This act shall take effect July 1, 2008.
