A bill to be entitled
2An act relating to health care in medically underserved
3areas; amending s. 893.02, F.S.; redefining the term
4"practitioner" to include an advanced registered nurse
5practitioner; authorizing an advanced registered nurse
6practitioner to prescribe certain controlled substances
7under a protocol with a licensed physician; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Subsection (19) of section 893.02, Florida
13Statutes, is amended to read:
14     893.02  Definitions.--The following words and phrases as
15used in this chapter shall have the following meanings, unless
16the context otherwise requires:
17     (19)  "Practitioner" means a physician licensed under
18pursuant to chapter 458, a dentist licensed under pursuant to
19chapter 466, a veterinarian licensed under pursuant to chapter
20474, an osteopathic physician licensed under pursuant to chapter
21459, a naturopath licensed under pursuant to chapter 462, or a
22podiatric physician licensed under pursuant to chapter 461, or
23an advanced registered nurse practitioner certified under s.
24464.012 whose practice is located within a medically underserved
25area or who provides care to a medically underserved population
26as designated by the Health Resources and Services
27Administration of the United States Department of Health and
28Human Services if provided such practitioner holds a valid
29federal controlled substance registry number. An advanced
30registered nurse practitioner certified under s. 464.012 whose
31practice is located within a medically underserved area or who
32provides care to a medically underserved population as
33designated by the Health Resources and Services Administration
34of the United States Department of Health and Human Services may
35prescribe substances listed in Schedule II, Schedule III,
36Schedule IV, or Schedule V of s. 893.03 to the extent authorized
37by a protocol with a physician licensed under chapter 458 or
38chapter 459.
39     Section 2.  This act shall take effect upon becoming a law.
