The Committee on Education Pre-K - 12 (Wise) recommended the

and insert:

Section 1. This act may be cited as "Erin's Law."
8
Section 2. Paragraph (d) of subsection (3) of section
9
1006.15, Florida Statutes, is amended, and paragraphs (e) and
10
(f) are added to that subsection, to read:
11
1006.15 Student standards for participation in
12
interscholastic extracurricular student activities;
13
regulation.--

(d) An individual charter school student pursuant to s.
16
1002.33 is eligible to participate at the public school to which
17
the student would be assigned according to district school board
18
attendance area policies or which the student could choose to
19
attend, pursuant to district or interdistrict controlled open-
20
enrollment provisions, in any interscholastic extracurricular
21
activity of that school, unless such activity is provided by the
22
student's charter school, if the following conditions are met:
23
1. The charter school student must meet the requirements
24
of the charter school education program as determined by the
25
charter school governing board.
26
2. During the period of participation at a school, the
27
charter school student must demonstrate educational progress by
28
maintaining the grade point average required by this section and
29
passing each class for which he or she is enrolled as required
30
in paragraph (b).
31
3. The charter school student must meet the same residency
32
requirements as other students in the school at which he or she
33
participates.
34
4. The charter school student must meet the same standards
35
of acceptance, behavior, and performance that are required of
36
other students in extracurricular activities.

5. The charter school student must register with the
38
school his or her intent to participate in interscholastic
39
extracurricular activities as a representative of the school
40
before the beginning date of the season for the activity in
41
which he or she wishes to participate. A charter school student
42
must be able to participate in curricular activities if that is
43
a requirement for an extracurricular activity.

6. A student who transfers from a charter school program
45
to a traditional public school before or during the first
46
grading period of the school year is academically eligible to
47
participate in interscholastic extracurricular activities during
48
the first grading period if the student has a successful
49
evaluation from the previous school year, pursuant to
50
subparagraph 2.
51
7. Any public school or private school student who has
52
been unable to maintain academic eligibility for participation
53
in interscholastic extracurricular activities is ineligible to
54
participate in such activities as a charter school student until
55
the student has successfully completed one grading period in a
56
charter school pursuant to subparagraph 2. to become eligible to
57
participate as a charter school student.

(e) A private school student is eligible to participate in
59
interscholastic sports at the public school to which the student
60
would be assigned according to the district school board's
61
attendance area policies or at a public school that the student
62
could choose to attend under district or interdistrict
63
controlled open enrollment provisions if all of the following
64
conditions are met:
65
1. The private school student meets the requirements of
66
the private school program pursuant to s. 1002.42.
67
2. The private school in which the student is enrolled
68
does not offer the interscholastic sports in which the student
69
would participate at the public school.

3. During the period of participation at the public
71
school, the private school student demonstrates educational
72
progress by maintaining the grade point average required by this
73
section and passing each class for which he or she is enrolled
74
in the private school program as confirmed by a transcript from
75
the private school. If the private school student is unable to
76
maintain academic eligibility for participating in
77
interscholastic sports, the student is ineligible to participate
78
in such activities until he or she successfully completes one
79
grading period in all subjects taken in the private school
80
program.

4. The private school student meets the same residency
82
requirements as other students in the school at which he or she
83
participates.

5. The private school student meets the same standards of
85
acceptance, behavior, and performance as required of other
86
students participating in interscholastic sports at the public
87
school.

6. The private school student registers with the public
89
school his or her intent to participate in interscholastic
90
sports as a representative of the school before the beginning
91
date of the season for the activity in which he or she wishes to
92
participate; however, the private school student must be able to
93
participate in curricular activities if that is a requirement
94
for interscholastic sports. A student who transfers from a
95
private school program to a public school before or during the
96
first grading period of the school year is academically eligible
97
to participate in interscholastic sports during the first
98
grading period if the student meets the requirements of
99
subparagraph 3. from the previous school year.

7. The private school in which the student is enrolled
101
provides an affidavit to the public school which states that the
102
private school:
103
a. Does not offer the interscholastic sports in which the
104
student would participate at the public school; and
105
b. Did not offer the interscholastic sports in which the
106
student would participate in during the prior academic year.

(f) A public school student is eligible to participate at
108
another public school in the student's school attendance area in
109
any interscholastic sports of that school if all of the
110
following conditions are met:
111
1. The public school in which the student is enrolled does
112
not offer the interscholastic sports in which the student would
113
participate at the public school.

2. During the period of participation at the school, the
115
student demonstrates educational progress as required in
116
paragraph (a).
117
3. The public school in which the student is enrolled is
118
in the same school district as that in which the student intends
119
to participate in the interscholastic sports under this section.

4. The student meets the same standards of acceptance,
121
behavior, and performance as required of other students in
122
interscholastic sports.

5. The student registers with the school his or her intent
124
to participate in interscholastic sports as a representative of
125
the school before the beginning date of the season for the
126
activity in which he or she wishes to participate. A student
127
must be able to participate in curricular activities if that is
128
a requirement for interscholastic sports.

6. A student who transfers from the school in which he or
130
she is enrolled to another public school before or during the
131
first grading period of the school year is academically eligible
132
to participate in interscholastic sports during the first
133
grading period if the student has a successful evaluation from
134
the previous school year pursuant to subparagraph 2.
135
7. Any public school student who has been unable to
136
maintain academic eligibility for participation in
137
interscholastic sports is ineligible to participate in such
138
activities until the student has successfully completed one
139
grading period in the student's home school pursuant to
140
subparagraph 2. to become eligible to participate.

Section 3. This act shall take effect July 1, 2008.
