An act relating to interscholastic extracurricular student

activities; amending s. 1006.15, F.S.; providing for

4

certain private school students to participate in

5

interscholastic extracurricular activities at a public

6

school under certain conditions; providing criteria;

7

providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Paragraph (e) is added to subsection (3) of

12

section 1006.15, Florida Statutes, to read:

13

     1006.15  Student standards for participation in

14

interscholastic extracurricular student activities; regulation.--

15

     (3)

     (e) A private school student is eligible to participate in

17

the interscholastic extracurricular activities at the public

18

school to which the student would be assigned according to the

19

district school board's attendance area policies or at a public

20

school that the student could choose to attend under district or

21

interdistrict controlled open enrollment provisions if all of the

22

following conditions are met:

     1. The private school student meets the requirements of the

24

private school program pursuant to s. 1002.42.

25

     2. The private school in which the student is enrolled does

26

not offer the interscholastic sports in which the student would

27

participate at the public school.

     3. During the period of participation at the public school,

29

the private school student demonstrates educational progress as

30

required in paragraph (b) in all subjects taken in the private

31

school program as confirmed by a transcript from the private

32

school. If the private school student is unable to maintain

33

academic eligibility for participating in interscholastic

34

extracurricular activities, the student is ineligible to

35

participate in such activities until he or she successfully

36

completes one grading period in all subjects taken in the private

37

school program.

     4. The private school student meets the same residency

39

requirements as other students in the school at which he or she

40

participates.

     5. The private school student meets the same standards of

42

acceptance, behavior, and performance as required of other

43

students in extracurricular activities at the public school.

     6. The private school student registers with the public

45

school his or her intent to participate in interscholastic

46

extracurricular activities as a representative of the school

47

before the beginning date of the season for the activity in which

48

he or she wishes to participate; however, the private school

49

student must be able to participate in curricular activities if

50

that is a requirement for an extracurricular activity. A student

51

who transfers from a private school program to a public school

52

before or during the first grading period of the school year is

53

academically eligible to participate in interscholastic

54

extracurricular activities during the first grading period if the

55

student meets the requirements of subparagraph 3. from the

56

previous school year.

     Section 2.  This act shall take effect July 1, 2008.
