An act relating to interscholastic sports; providing a

short title; amending s. 1006.15, F.S.; revising the

criteria under which a charter school student may
5
participate in interscholastic extracurricular activities
6
of a public school; providing for certain private school
7
students to participate in interscholastic sports at a
8
public school under certain conditions; providing
9
criteria; providing for a public school student to
10
participate in interscholastic sports at another public
11
school; providing criteria; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:
14

Section 1. This act may be cited as "Erin's Law."
16
Section 2. Paragraph (d) of subsection (3) of section
17
1006.15, Florida Statutes, is amended, and paragraphs (e) and (f)
18
are added to that subsection, to read:
19
1006.15 Student standards for participation in
20
interscholastic extracurricular student activities; regulation.--

(d) An individual charter school student pursuant to s.
23
1002.33 is eligible to participate at the public school to which
24
the student would be assigned according to district school board
25
attendance area policies or which the student could choose to
26
attend, pursuant to district or interdistrict controlled open-
27
enrollment provisions, in any interscholastic extracurricular
28
activity of that school, unless such activity is provided by the
29
student's charter school, if the following conditions are met:
30
1. The charter school student must meet the requirements of
31
the charter school education program as determined by the charter
32
school governing board.

2. During the period of participation at a school, the
34
charter school student must demonstrate educational progress by
35
maintaining the grade point average required by this section and
36
passing each class for which he or she is enrolled as required in
37
paragraph (b).

3. The charter school student must meet the same residency
39
requirements as other students in the school at which he or she
40
participates.

4. The charter school student must meet the same standards
42
of acceptance, behavior, and performance that are required of
43
other students in extracurricular activities.

5. The charter school student must register with the school
45
his or her intent to participate in interscholastic
46
extracurricular activities as a representative of the school
47
before the beginning date of the season for the activity in which
48
he or she wishes to participate. A charter school student must be
49
able to participate in curricular activities if that is a
50
requirement for an extracurricular activity.

6. A student who transfers from a charter school program to
52
a traditional public school before or during the first grading
53
period of the school year is academically eligible to participate
54
in interscholastic extracurricular activities during the first
55
grading period if the student has a successful evaluation from
56
the previous school year, pursuant to subparagraph 2.
57
7. Any public school or private school student who has been
58
unable to maintain academic eligibility for participation in
59
interscholastic extracurricular activities is ineligible to
60
participate in such activities as a charter school student until
61
the student has successfully completed one grading period in a
62
charter school pursuant to subparagraph 2. to become eligible to
63
participate as a charter school student.

(e) A private school student is eligible to participate in
65
interscholastic sports at the public school to which the student
66
would be assigned according to the district school board's
67
attendance area policies or at a public school that the student
68
could choose to attend under district or interdistrict controlled
69
open enrollment provisions if all of the following conditions are
70
met:
71
1. The private school student meets the requirements of the
72
private school program pursuant to s. 1002.42.
73
2. The private school in which the student is enrolled does
74
not offer the interscholastic sports in which the student would
75
participate at the public school.

3. During the period of participation at the public school,
77
the private school student demonstrates educational progress by
78
maintaining the grade point average required by this section and
79
passing each class for which he or she is enrolled in the private
80
school program as confirmed by a transcript from the private
81
school. If the private school student is unable to maintain
82
academic eligibility for participating in interscholastic sports,
83
the student is ineligible to participate in such activities until
84
he or she successfully completes one grading period in all
85
subjects taken in the private school program.

4. The private school student meets the same residency
87
requirements as other students in the school at which he or she
88
participates.

5. The private school student meets the same standards of
90
acceptance, behavior, and performance as required of other
91
students participating in interscholastic sports at the public
92
school.

6. The private school student registers with the public
94
school his or her intent to participate in interscholastic sports
95
as a representative of the school before the beginning date of
96
the season for the activity in which he or she wishes to
97
participate; however, the private school student must be able to
98
participate in curricular activities if that is a requirement for
99
interscholastic sports. A student who transfers from a private
100
school program to a public school before or during the first
101
grading period of the school year is academically eligible to
102
participate in interscholastic sports during the first grading
103
period if the student meets the requirements of subparagraph 3.

from the previous school year.

7. The private school in which the student is enrolled
106
provides an affidavit to the public school which states that the
107
private school:
108
a. Does not offer the interscholastic sports in which the
109
student would participate at the public school; and
110
b. Did not offer the interscholastic sports in which the
111
student would participate in during the prior academic year.

(f) A public school student is eligible to participate in
113
interscholastic sports at another public school to which the
114
student would be assigned according to the district school
115
board's attendance area policies or at a public school that the
116
student could choose to attend under district controlled open
117
enrollment provisions if all of the following conditions are met:
118
1. The public school in which the student is enrolled does
119
not offer the interscholastic sports in which the student would
120
participate at the public school.

2. During the period of participation at the school, the
122
student demonstrates educational progress as required in
123
paragraph (a).
124
3. The public school in which the student is enrolled is in
125
the same school district as that in which the student intends to
126
participate in the interscholastic sports under this section.

4. The student meets the same standards of acceptance,
128
behavior, and performance as required of other students in
129
interscholastic sports.

5. The student registers with the school his or her intent
131
to participate in interscholastic sports as a representative of
132
the school before the beginning date of the season for the
133
activity in which he or she wishes to participate. A student must
134
be able to participate in curricular activities if that is a
135
requirement for interscholastic sports.

6. A student who transfers from the school in which he or
137
she is enrolled to another public school before or during the
138
first grading period of the school year is academically eligible
139
to participate in interscholastic sports during the first grading
140
period if the student has a successful evaluation from the
141
previous school year pursuant to subparagraph 2.

7. Any public school student who has been unable to
143
maintain academic eligibility for participation in
144
interscholastic sports is ineligible to participate in such
145
activities until the student has successfully completed one
146
grading period in the student's home school pursuant to
147
subparagraph 2. to become eligible to participate.

Section 3. This act shall take effect July 1, 2008.
