5 | Section 1. Section 376.30715, Florida Statutes, is amended |
6 | to read: |
7 | 376.30715 Innocent victim petroleum storage system |
8 | restoration.--A contaminated site acquired by the current owner |
9 | prior to July 1, 1990, which has ceased operating as a petroleum |
10 | storage or retail business prior to January 1, 1985, is eligible |
11 | for financial assistance pursuant to s. 376.305(6), |
12 | notwithstanding s. 376.305(6)(a). For purposes of this section, |
13 | the term "acquired" means the acquisition of title to the |
14 | property; however, a subsequent transfer of the property to a |
15 | spouse, a surviving spouse in trust or free of trust, or a |
16 | revocable trust created for the benefit of the settlor does not |
17 | disqualify the site from financial assistance pursuant to s. |
18 | 376.305(6). Eligible sites shall be ranked in accordance with s. |
19 | 376.3071(5). |
