An act relating to sexual battery time limitations;

amending s. 775.15, F.S.; revising time limitations for

4

prosecution of certain sexual battery offenses involving

5

minor victims; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Paragraph (c) is added to subsection (13) of

10

section 775.15, Florida Statutes, to read:

11

     775.15  Time limitations; general time limitations;

12

exceptions.--

     (c) If the offense is a second-degree felony violation of

15

s. 794.011 and the victim was under 18 years of age at the time

16

the offense was committed, a prosecution of the offense may be

17

commenced at any time. This paragraph applies to any such offense

18

except an offense the prosecution of which would have been barred

19

by subsection (2) on or before October 1, 2008.

     Section 2.  This act shall take effect October 1, 2008.
