An act relating to temporary motor vehicle license tags;

amending s. 320.131, F.S.; revising provisions for the

placement of temporary tags on vehicles; revising
5
provisions for implementation of an electronic system for
6
entry of vehicle and owner data upon issuance of temporary
7
tags; revising provisions for implementation of an
8
electronic, print-on demand, temporary tag issuance
9
system; authorizing a motor vehicle dealer to charge a fee
10
in certain circumstances; repealing s. 320.96, F.S.,
11
relating to implementation of an electronic, print-on-
12
demand, temporary license plate system; providing an
13
effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Subsections (4) and (8) of section 320.131,
18
Florida Statutes, are amended, and subsection (9) is added to
19
that section, to read:

320.131 Temporary tags.--
21
(4)(a) Temporary tags shall be conspicuously displayed in
22
the rear license plate bracket or, attached to the inside of the
23
rear window in an upright position so as to be clearly visible
24
from the rear of the vehicle. on vehicles requiring front display
25
of license plates, temporary tags shall be displayed on the front
26
of the vehicle in the location where the metal license plate
27
would normally be displayed.

(b) The department shall designate specifications for the
29
media upon which the temporary tag is printed. Such media shall
30
be either nonpermeable or subject to weatherproofing so that it
31
maintains its structural integrity, including graphic and data
32
adhesion, in all weather conditions after being placed on a
33
vehicle.

(8) The department shall may administer an electronic
35
system for licensed motor vehicle dealers to use for in issuing
36
temporary tags license plates. Upon issuing a temporary tag
37
license plate, the dealer shall access the electronic system and
38
enter the appropriate vehicle and owner information within the
39
timeframe specified by department rule. If a dealer fails to
40
comply with the department's requirements for issuing temporary
41
tags license plates using the electronic system, the department
42
may deny, suspend, or revoke a license under s. 320.27(9)(b)16.

upon proof that the licensee has failed to comply with the
44
department's requirements. The department may adopt rules to
45
administer this section.

(9) The department shall implement a secure print-on-demand
47
electronic temporary tag registration, record retention, and
48
issue system for use by every department-authorized issuer of
49
temporary tags by the end of the 2007-2008 fiscal year. This
50
system shall enable the department to issue, on demand, a
51
temporary tag number in response to a request from the issuer via
52
a secure electronic exchange of data and enable the issuer to
53
print the temporary tag with all required information. The
54
department may adopt rules as necessary to implement this
55
program. A motor vehicle dealer licensed under this chapter may
56
charge a fee in order to comply with this section.

Section 2. Section 320.96, Florida Statutes, is repealed.
58
Section 3. This act shall take effect upon becoming a law.
