A bill to be entitled
2An act relating to domestic violence; amending s. 784.047,
3F.S.; adding circumstances that violate an injunction for
4protection against repeat violence, sexual violence, or
5dating violence; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:
8
9     Section 1.  Section 784.047, Florida Statutes, is amended
10to read:
11     784.047  Penalties for violating protective injunction
12against violators.--A person who willfully violates an
13injunction for protection against repeat violence, sexual
14violence, or dating violence, issued pursuant to s. 784.046, or
15a foreign protection order accorded full faith and credit
16pursuant to s. 741.315 by:
17     (1)  Refusing to vacate the dwelling that the parties
18share;
19     (2)  Going to, or being within 500 feet of, the
20petitioner's residence, school, place of employment, or a
21specified place frequented regularly by the petitioner and any
22named family or household member;
23     (3)  Committing an act of repeat violence, sexual violence,
24or dating violence against the petitioner;
25     (4)  Committing any other violation of the injunction
26through an intentional unlawful threat, word, or act to do
27violence to the petitioner; or
28     (5)  Telephoning, contacting, or otherwise communicating
29with the petitioner directly or indirectly, unless the
30injunction specifically allows indirect contact through a third
31party;
32     (6)  Knowingly and intentionally coming within 100 feet of
33the petitioner's motor vehicle, whether or not that vehicle is
34occupied;
35     (7)  Defacing or destroying the petitioner's personal
36property, including the petitioner's motor vehicle; or
37     (8)  Refusing to surrender firearms or ammunition if
38ordered to do so by the court,

40commits a misdemeanor of the first degree, punishable as
41provided in s. 775.082 or s. 775.083.
42     Section 2.  This act shall take effect July 1, 2008.
