Section 28. Subsections (4) and (5) of section 477.019,
7
Florida Statutes, are amended, subsections (5) through (7) of
8
that section are renumbered as subsections (6) through (8),
9
respectively, and a new subsection (3) is added to that section,
10
to read:
11
477.019 Cosmetologists; qualifications; licensure;
12
supervised practice; license renewal; endorsement; continuing
13
education.--

(3) An application for the licensure examination for any
15
license under this section may be submitted for examination
16
approval in the last 100 hours of training by a pregraduate of a
17
licensed cosmetology school or a program within the public school
18
system, which school or program is certified by the Department of
19
Education with fees as required in paragraph (2)(b). Upon
20
approval, the applicant may schedule the examination on a date
21
when the training hours are completed. An applicant shall have 6
22
months from the date of approval to take the examination. After
23
the 6 months have passed, if the applicant failed to take the
24
examination, the applicant must reapply. The board shall
25
establish by rule the procedures for the pregraduate application
26
process.

(4) (3) Upon an applicant receiving a passing grade, as
28
established by board rule, on the examination and paying the
29
initial licensing fee, the department shall issue a license to
30
practice cosmetology.

(5) (4) If an applicant passes all parts of the examination
32
for licensure as a cosmetologist, he or she may practice in the
33
time between passing the examination and receiving a physical
34
copy of his or her license if he or she practices under the
35
supervision of a licensed cosmetologist in a licensed salon. An
36
applicant who fails any part of the examination may not practice
37
as a cosmetologist and may immediately apply for reexamination.

Following the completion of the first licensing examination and
39
pending the results of that examination and issuance of a license
40
to practice cosmetology, graduates of licensed cosmetology
41
schools or cosmetology programs offered in public school systems,
42
which schools or programs are certified by the Department of
43
Education, are eligible to practice cosmetology, provided such
44
graduates practice under the supervision of a licensed
45
cosmetologist in a licensed cosmetology salon. A graduate who
46
fails the first examination may continue to practice under the
47
supervision of a licensed cosmetologist in a licensed cosmetology
48
salon if the graduate applies for the next available examination
49
and until the graduate receives the results of that examination.
50
No graduate may continue to practice under this subsection if the
51
graduate fails the examination twice.
