| 5 | Section 27. Paragraph (d) is added to subsection (2) of |
| 6 | section 477.019, Florida Statutes, and subsection (4) of that |
| 7 | section is amended, to read: |
| 8 | 477.019 Cosmetologists; qualifications; licensure; |
| 9 | supervised practice; license renewal; endorsement; continuing |
| 10 | education.-- |
| 11 | (2) An applicant shall be eligible for licensure by |
| 12 | examination to practice cosmetology if the applicant: |
| 13 | (d) Has submitted for examination approval in the last 100 |
| 14 | hours of training by a pregraduate of a licensed cosmetology |
| 15 | school or a program within the public school system, if such |
| 16 | school or program is certified by the Department of Education |
| 17 | and the applicant pays the application fee as required in |
| 18 | paragraph (b). Upon approval and the completion of all required |
| 19 | training, the applicant may schedule an examination. An |
| 20 | applicant must take the examination within 6 months from the |
| 21 | date on which he or she receives approval. If the applicant |
| 22 | fails to take the examination within the 6-month period, he or |
| 23 | she must reapply for examination approval. The board shall |
| 24 | establish by rule procedures for the pregraduate application |
| 25 | process. |
| 26 | (4) If an applicant passes all parts of the examination |
| 27 | for licensure as a cosmetologist, he or she may practice in the |
| 28 | time between passing the examination and receiving a physical |
| 29 | copy of his or her license if he or she practices under the |
| 30 | supervision of a licensed cosmetologist in a licensed salon. An |
| 31 | applicant who fails any part of the examination may not practice |
| 32 | as a cosmetologist and may immediately apply for reexamination. |
| 33 | Following the completion of the first licensing examination and |
| 34 | pending the results of that examination and issuance of a |
| 35 | license to practice cosmetology, graduates of licensed |
| 36 | cosmetology schools or cosmetology programs offered in public |
| 37 | school systems, which schools or programs are certified by the |
| 38 | Department of Education, are eligible to practice cosmetology, |
| 39 | provided such graduates practice under the supervision of a |
| 40 | licensed cosmetologist in a licensed cosmetology salon. A |
| 41 | graduate who fails the first examination may continue to |
| 42 | practice under the supervision of a licensed cosmetologist in a |
| 43 | licensed cosmetology salon if the graduate applies for the next |
| 44 | available examination and until the graduate receives the |
| 45 | results of that examination. No graduate may continue to |
| 46 | practice under this subsection if the graduate fails the |
| 47 | examination twice. |
