3     Amendment to Amendment (023651) (with title amendment)
4     Between lines 1104 and 1105, insert:
5     Section 27.  Paragraph (d) is added to subsection (2) of
6section 477.019, Florida Statutes, and subsection (4) of that
7section is amended, to read:
8     477.019  Cosmetologists; qualifications; licensure;
9supervised practice; license renewal; endorsement; continuing
10education.--
11     (2)  An applicant shall be eligible for licensure by
12examination to practice cosmetology if the applicant:
13     (d)  Has submitted for examination approval in the last 100
14hours of training by a pregraduate of a licensed cosmetology
15school or a program within the public school system, if such
16school or program is certified by the Department of Education
17and the applicant pays the application fee as required in
18paragraph (b). Upon approval and the completion of all required
19training, the applicant may schedule an examination. An
20applicant must take the examination within 6 months from the
21date on which he or she receives approval. If the applicant
22fails to take the examination within the 6-month period, he or
23she must reapply for examination approval. The board shall
24establish by rule procedures for the pregraduate application
25process.
26     (4)  If an applicant passes all parts of the examination
27for licensure as a cosmetologist, he or she may practice in the
28time between passing the examination and receiving a physical
29copy of his or her license if he or she practices under the
30supervision of a licensed cosmetologist in a licensed salon. An
31applicant who fails any part of the examination may not practice
32as a cosmetologist and may immediately apply for reexamination.
33Following the completion of the first licensing examination and
34pending the results of that examination and issuance of a
35license to practice cosmetology, graduates of licensed
36cosmetology schools or cosmetology programs offered in public
37school systems, which schools or programs are certified by the
38Department of Education, are eligible to practice cosmetology,
39provided such graduates practice under the supervision of a
40licensed cosmetologist in a licensed cosmetology salon. A
41graduate who fails the first examination may continue to
42practice under the supervision of a licensed cosmetologist in a
43licensed cosmetology salon if the graduate applies for the next
44available examination and until the graduate receives the
45results of that examination. No graduate may continue to
46practice under this subsection if the graduate fails the
47examination twice.
