and insert:

permitholder, in the year 2009, the conduct of at least 20 live

regular wagering performances, in the years 2010 and 2011, the

conduct of at least 30 live regular wagering performances, and

for every year after the year 2011, the conduct of at least 40

10

live regular wagering performances during the preceding year; and

for a thoroughbred permitholder, the
