| 2 | An act relating to legislative authority to ratify |
| 3 | compacts and agreements; defining terms; designating the |
| 4 | Governor as the official to negotiate and execute compacts |
| 5 | and agreements; providing for ratification of compacts and |
| 6 | agreements by the Legislature; providing for submission of |
| 7 | compacts and agreements to the Legislature and Secretary |
| 8 | of State; providing for submission of compacts and |
| 9 | agreements to signatories for review and approval; |
| 10 | providing an effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. (1) For purposes of this section: |
| 15 | (a) "Compact" includes, but is not limited to, any |
| 16 | interstate compact between the State of Florida and other states |
| 17 | and any tribal-state compact between the State of Florida and an |
| 18 | Indian tribe in this state. |
| 19 | (b) "Agreement" includes, but is not limited to, any |
| 20 | mutual-aid agreement with agencies of other states that is |
| 21 | understood to have the status of a compact but is not actually |
| 22 | an agreement between states, or any similar agreement. |
| 23 | (2) The Governor is the designated state officer |
| 24 | responsible for negotiating and executing, on behalf of the |
| 25 | state, compacts and agreements with other states, agencies of |
| 26 | other states, or an Indian tribe in this state. |
| 27 | (3) Any compact or agreement which is entered into by |
| 28 | other states, agencies of other states, or an Indian tribe in |
| 29 | this state and the Governor pursuant to subsection (2) must be |
| 30 | conditioned upon ratification by the Legislature. |
| 31 | (4) Following completion of negotiations, the Governor |
| 32 | shall submit a copy of any executed compact or agreement for |
| 33 | ratification by a majority vote by both houses of the |
| 34 | Legislature and shall submit a copy of the executed compact or |
| 35 | agreement to the Secretary of State pending receipt of an act |
| 36 | ratifying the compact or agreement under the provisions of this |
| 37 | section. |
| 38 | (5) Upon receipt of an act ratifying the compact or |
| 39 | agreement, the Secretary of State shall forward a copy of the |
| 40 | executed compact or agreement and the ratifying act to the |
| 41 | signatories to the compact or agreement for review and approval. |
| 42 | Section 2. This act shall take effect upon becoming a law. |
