A bill to be entitled

An act relating to emergency medical dispatchers; amending

s. 768.1335, F.S.; requiring such dispatchers to have
4
completed a training course before answering calls;

providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Subsection (3) of section 768.1335, Florida
10
Statutes, is amended to read:
11
768.1335 Emergency Medical Dispatch Act; presumption.--
12
(3) Notwithstanding any other provision of law to the
13
contrary, and unless otherwise immune under s. 768.28, any
14
emergency medical dispatcher or the emergency medical dispatch
15
agency, its agents, or its employees who utilize emergency
16
medical dispatch protocols are presumed not to have acted
17
negligently regarding any injuries or damages resulting from the
18
use of emergency medical dispatch protocols, if the emergency
19
medical dispatcher or the emergency medical dispatch agency, its
20
agents, or its employees:

(a) Properly trained their emergency medical dispatchers in
22
an emergency medical dispatch that is substantially similar to
23
standards set forth by the American Society for Testing and
24
Materials or the National Highway Traffic Safety Administration.
25
Such dispatchers must have successfully completed an emergency
26
medical dispatch course before being allowed to answer any calls
27
for medical assistance.

(b) Implemented standard practices and management for
29
emergency medical dispatch or practices that are substantially
30
similar to standards set forth by the American Society for
31
Testing and Materials or the National Highway Traffic Safety
32
Administration.

(c) Utilized standard practices for training, instructor
34
qualification, and certification eligibility of emergency medical
35
dispatchers or practices that are substantially similar to
36
standards set forth by the American Society for Testing and
37
Materials or the National Highway Traffic Safety Administration.
38
Section 2. This act shall take effect July 1, 2008.
