An act relating to domestic violence; amending s. 784.047,

F.S.; adding circumstances that violate an injunction for
4
protection against repeat violence, sexual violence, or
5
dating violence; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Section 784.047, Florida Statutes, is amended to
10
read:

784.047 Penalties for violating protective injunction
12
against violators.--A person who willfully violates an injunction
13
for protection against repeat violence, sexual violence, or
14
dating violence, issued pursuant to s. 784.046, or a foreign
15
protection order accorded full faith and credit pursuant to s.
16
741.315 by:
17
(1) Refusing to vacate the dwelling that the parties share;
18
(2) Going to, or being within 500 feet of, the petitioner's
19
residence, school, place of employment, or a specified place
20
frequented regularly by the petitioner and any named family or
21
household member;
22
(3) Committing an act of repeat violence, sexual violence,
23
or dating violence against the petitioner;
24
(4) Committing any other violation of the injunction
25
through an intentional unlawful threat, word, or act to do
26
violence to the petitioner; or
27
(5) Telephoning, contacting, or otherwise communicating
28
with the petitioner directly or indirectly, unless the injunction
29
specifically allows indirect contact through a third party;
30
(6) Knowingly and intentionally coming within 100 feet of
31
the petitioner's motor vehicle, whether or not that vehicle is
32
occupied;

(7) Defacing or destroying the petitioner's personal
34
property, including the petitioner's motor vehicle; or
35
(8) Refusing to surrender firearms or ammunition if ordered
36
to do so by the court,

commits a misdemeanor of the first degree, punishable as provided

Section 2. This act shall take effect July 1, 2008.
