A bill to be entitled
2An act relating to supplemental educational services;
3amending s. 1008.331, F.S.; requiring the Department of
4Education to annually assign grades to state-approved
5supplemental educational services providers; specifying
6evaluation criteria; providing for rules; requiring the
7department to report grades; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Subsection (5) of section 1008.331, Florida
12Statutes, is renumbered as subsection (6) and a new subsection
13(5) is added to that section to read:
14     1008.331  Supplemental educational services in Title I
15schools; school district, and provider, and department
16responsibilities.--
17     (5)  RESPONSIBILITIES OF THE DEPARTMENT OF EDUCATION.--
18     (a)  Beginning with the 2007-2008 school year, the
19department shall annually assign to each state-approved
20supplemental educational services provider one of the following
21grades, defined according to rules of the State Board of
22Education:
23     1.  "A," providing superior service.
24     2.  "B," providing above satisfactory service.
25     3.  "C," providing satisfactory service.
26     4.  "D," providing below satisfactory service.
27     5.  "F," providing unsatisfactory service.
28     (b)  A state-approved supplemental educational services
29provider's grade shall be based on a combination of student
30learning gains and student proficiency levels as measured by the
31statewide assessment pursuant to s. 1008.22 for students in
32grades 4 through 12 and norm-referenced tests approved by the
33department for students in kindergarten through grade 3.
34     (c)  The department shall report by March 1, 2009, and by
35March 1 each year thereafter, the grades it assigns under this
36subsection to the supplemental educational services providers,
37the school districts, parents, and the public.
38     Section 2.  This act shall take effect July 1, 2008.
