5certain circumstances; providing an exception; creating s.
6459.0052, F.S.; prohibiting the department from
7registration for medical residency or licensure under
8certain circumstances; providing an exception; providing
9an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Section 458.3096, Florida Statutes, is created
14to read:
15     458.3096  Prohibition of medical residency or licensure in
16the state; grounds for prohibition; exception.--
17     (1)  The department shall not register a person under s.
18458.345 who is a United States citizen or United States resident
19who has traveled to Cuba to receive medical training or a
20medical degree. In addition, the department shall not issue a
21license under this chapter to any United States citizen or
22United States resident who has traveled to Cuba to receive
23medical training or a medical degree.
24     (2)  This prohibition does not apply to any native or
25citizen of Cuba who received his or her medical training or
26medical degree in Cuba prior to immigrating to the United
27States.
28     Section 2.  Section 459.0052, Florida Statutes, is created
29to read:
30     459.0052  Prohibition of medical residency or licensure in
31the state; grounds for prohibition; exception.--
32     (1)  The department shall not register a person under s.
33459.021 who is a United States citizen or United States resident
34who has traveled to Cuba to receive medical training or a
35medical degree. In addition, the department shall not issue a
36license under this chapter to any United States citizen or
37United States resident who has traveled to Cuba to receive
38medical training or a medical degree.
39     (2)  This prohibition does not apply to any native or
40citizen of Cuba who received his or her medical training or
41medical degree in Cuba prior to immigrating to the United
42States.
43     Section 3.  This act shall take effect July 1, 2008.
