A reviser's bill to be entitled

18become inoperative by noncurrent repeal or expiration and,
19pursuant to s. 11.242(5)(b) and (i), may be omitted from
20the 2008 Florida Statutes only through a reviser's bill
21duly enacted by the Legislature; amending s. 373.459,
22F.S., to conform to the repeal of s. 403.885(3); and
23amending ss. 617.0802 and 627.7261, F.S., to conform to
24the repeal of chapter 737, F.S.; providing an effective
25date.

27Be It Enacted by the Legislature of the State of Florida:
28
29     Section 1.  Section 14.325, Florida Statutes, is repealed.
30Reviser's note.--The cited section, which creates the
31Council on State Agency Inspectors General, was repealed
32pursuant to its own terms, effective June 30, 2007.
33     Section 2.  Subsections (4), (5), (6), (7), and (8) of
34section 211.027, Florida Statutes, are repealed.
35Reviser's note.--Subsections (4), (5), and (6), which
36relate to tax exemptions for oil and gas produced under
37specified parameters, were repealed pursuant to subsection
38(8), effective June 30, 2007. Subsection (7) only serves to
39prohibit new exemptions per subsections (4)-(6) after June
4030, 2002, and has served its purpose; subsection (8) only
41serves to provide the repeal of subsections (4)-(6) and has
42served its purpose.
43     Section 3.  Paragraph (i) of subsection (2) of section
44216.181, Florida Statutes, is repealed.
45Reviser's note.--The cited paragraph, which authorizes the
46Agency for Persons with Disabilities to submit a specified
47budget amendment, expired pursuant to its own terms,
48effective July 1, 2007.
49     Section 4.  Subsection (4) of section 252.373, Florida
50Statutes, is repealed.
51Reviser's note.--The cited subsection, which provides that
52otherwise unobligated funds in the Emergency Management,
53Preparedness, and Assistance Trust Fund may be authorized
54for expenditures to provide assistance to local governments
55for implementing local comprehensive plans, innovative
56planning to make communities more livable, and addressing
57growth management issues, expired pursuant to its own
58terms, effective July 1, 2007.
59     Section 5.  Paragraph (b) of subsection (4) and paragraph
60(g) of subsection (11) of section 259.032, Florida Statutes, are
61repealed.
62Reviser's note.--Paragraph (4)(b), which relates to
63transfer of moneys from the Conservation and Recreation
64Lands Trust Fund to the Florida Forever Trust Fund or the
65Land Acquisition Trust Fund, expired pursuant to its own
66terms, effective July 1, 2007. Paragraph (11)(g), which
67provides for a specified appropriation from funds deposited
68into the Florida Preservation 2000 Trust Fund and the
69Florida Forever Trust Fund for construction of replacement
70museum facilities for the 2006-2007 fiscal year, expired
71pursuant to its own terms, effective July 1, 2007.
72     Section 6.  Paragraph (b) of subsection (14) of section
73287.057, Florida Statutes, is repealed.
74Reviser's note.--The cited paragraph, which authorizes the
75implementation of a privatization initiative for a secure
76facility by the Department of Children and Family Services,
77expired pursuant to its own terms, effective July 1, 2007.
78     Section 7.  Section 288.039, Florida Statutes, is repealed.
79Reviser's note.--The cited section, which relates to the
80Employing and Training our Youths (ENTRY) program, expired
81pursuant to its own terms, effective June 30, 2007.
82     Section 8.  Subsection (3) of section 311.22, Florida
83Statutes, is repealed.
84Reviser's note.--The cited subsection, which relates to a
85minimum 25 percent match of funds received for certain
86dredging projects for the 2006-2007 fiscal year only,
87expired pursuant to its own terms, effective July 1, 2007.
88     Section 9.  Subsection (4) of section 370.13, Florida
89Statutes, is repealed.
90Reviser's note.--The cited subsection, which provides for
91waiver of stone crab trap tag fees for the 2006-2007 fiscal
92year only, expired pursuant to its own terms, effective
93July 1, 2007.
94     Section 10.  Subsection (7) of section 370.142, Florida
95Statutes, is repealed.
96Reviser's note.--The cited subsection, which provides for
97waiver of spiny lobster trap tag fees for the 2006-2007
98fiscal year only, expired pursuant to its own terms,
99effective July 1, 2007.
100     Section 11.  Subsection (12) of section 373.59, Florida
101Statutes, is repealed.
102Reviser's note.--The cited subsection, which authorizes
103transfer of moneys from the Water Management Lands Trust
104Fund to the Florida Forever Trust Fund or the Land
105Acquisition Trust Fund, expired pursuant to its own terms,
106effective July 1, 2007.
107     Section 12.  Paragraph (b) of subsection (3) of section
108375.041, Florida Statutes, is repealed.
109Reviser's note.--The cited paragraph, which authorizes
110expenditure or transfer to the Florida Forever Trust Fund
111and the Save Our Everglades Trust Fund of moneys in the
112Land Acquisition Trust Fund to support programs authorized
113in chapters 259 and 373, for the 2006-2007 fiscal year
114only, expired pursuant to its own terms, effective July 1,
1152007.
116     Section 13.  Subsection (5) of section 381.0402, Florida
117Statutes, is repealed.
118Reviser's note.--The cited subsection, which provides that
119the Department of Health may not use any portion of the
120annual appropriation for the area health education center
121network to administer or evaluate the network, expired
122pursuant to its own terms, effective July 1, 2007.
123     Section 14.  Subsection (3) of section 403.885, Florida
124Statutes, is repealed.
125Reviser's note.--The cited subsection, which provides for a
126grant program to use funds appropriated for certain water
127projects, expired pursuant to its own terms, effective July
1281, 2007.
129     Section 15.  Subsection (2) of section 502.015, Florida
130Statutes, is repealed.
131Reviser's note.--The cited subsection, which provides that,
132for the 2006-2007 fiscal year only, moneys in the General
133Inspection Trust Fund may be appropriated for programs
134operated by the Department of Agriculture and Consumer
135Services which are related to the programs authorized under
136chapter 502, which relates to milk and milk products,
137expired pursuant to its own terms, effective July 1, 2007.
138     Section 16.  Sections 737.101 737.105, 737.106, 737.111,

149Reviser's note.--The cited sections, which make up chapter
150737, relating to trust administration, were repealed by s.
15148, ch. 2006-217, Laws of Florida, effective July 1, 2007.
152Since the sections were not repealed by a "current session"
153of the Legislature, they may be omitted from the 2008
154Florida Statutes only through a reviser's bill duly enacted
155by the Legislature. See s. 11.242(5)(b) and (i).
156     Section 17.  Subsection (6) of section 373.459, Florida
157Statutes, is amended to read:
158     373.459  Funds for surface water improvement and
159management.--
160     (6)  The match requirement of subsection (2) shall not
161apply to the Suwannee River Water Management District, the
162Northwest Florida Water Management District, or a financially
163disadvantaged small local government as defined in former s.
164403.885(3).
165Reviser's note.--Amended to conform to the expiration of s.
166403.885(3) by its own terms, effective July 1, 2007; that
167expiration is confirmed by this act.
168     Section 18.  Subsection (2) of section 617.0802, Florida
169Statutes, is amended to read:
170     617.0802  Qualifications of directors.--
171     (2)  In the event that the eligibility to serve as a member
172of the board of directors of a condominium association,
173cooperative association, homeowners' association, or mobile home
174owners' association is restricted to membership in such
175association and membership is appurtenant to ownership of a
176unit, parcel, or mobile home, a grantor of a trust described in
177s. 733.707(3), or a beneficiary as defined in former s.
178737.303(4)(b) of a trust which owns a unit, parcel, or mobile
179home shall be deemed a member of the association and eligible to
180serve as a director of the condominium association, cooperative
181association, homeowners' association, or mobile home owners'
182association, provided that said beneficiary occupies the unit,
183parcel, or mobile home.
184Reviser's note.--Amended to conform to the repeal of s.
185737.303 by s. 48, ch. 2006-217, Laws of Florida; that
186repeal is confirmed by this act. The definition of
187"beneficiary" in s. 737.303(4)(b) was not included in the
188new Trust Code, chapter 736.
189     Section 19.  Paragraph (b) of subsection (2) of section
190627.7261, Florida Statutes, is amended to read:
191     627.7261  Refusal to issue policy.--
192     (2)
193     (b)  As used in this section, the term "volunteer driver"
194means a person who provides services, including transporting
195individuals or goods, without compensation in excess of expenses
196to a private nonprofit agency as defined in s. 273.01(3) or a
197charitable organization as defined in s. 736.1201(1) 737.501(2).
198Reviser's note.--Amended to conform to the repeal of s.
199737.501 by s. 48, ch. 2006-217, Laws of Florida; that
200repeal is confirmed by this act. Section 736.1201(1),
201created by s. 12, ch. 2006-217, as part of the Trust Code,
202chapter 736, which replaced chapter 737 on trust
203administration, provides the same definition of "charitable
204organization" found in s. 737.501(2).
205     Section 20.  This act shall take effect on the 60th day
206after adjournment sine die of the session of the Legislature in
207which enacted.
