5 | Section 1. Paragraph (a) of subsection (3) of section |
6 | 27.40, Florida Statutes, is amended to read: |
7 | 27.40 Court-appointed counsel; circuit registries; minimum |
8 | requirements; appointment by court.-- |
9 | (3) In utilizing a registry: |
10 | (a) The chief judge of the circuit shall compile a list of |
11 | attorneys in private practice, by county and by category of |
12 | cases, and provide the list to the clerk of court in each |
13 | county. From October 1, 2005, through September 30, 2009 2007, |
14 | the list of attorneys compiled by the Eleventh Judicial Circuit |
15 | shall provide the race, gender, and national origin of assigned |
16 | attorneys. To be included on a registry, attorneys shall certify |
17 | that they meet any minimum requirements established in general |
18 | law for court appointment, are available to represent indigent |
19 | defendants in cases requiring court appointment of private |
20 | counsel, and are willing to abide by the terms of the contract |
21 | for services. To be included on a registry, an attorney also |
22 | must enter into a contract for services with the Justice |
23 | Administrative Commission. Failure to comply with the terms of |
24 | the contract for services may result in termination of the |
25 | contract and removal from the registry. Each attorney on the |
26 | registry shall be responsible for notifying the clerk of the |
27 | court and the Justice Administrative Commission of any change in |
28 | his or her status. Failure to comply with this requirement shall |
29 | be cause for termination of the contract for services and |
30 | removal from the registry until the requirement is fulfilled. |
