| 4 | Remove line 73 and insert: |
| 5 | (5) If, in its discretion, it determines that it is |
| 6 | in the best interests of the public, the Department of |
| 7 | Transportation may pay a stipend to firms who have submitted |
| 8 | responsive proposals on design/build contracts unsuccessfully. |
| 9 | The decision to pay a stipend and the amount thereof shall be |
| 10 | based upon the department's analysis of the estimated cost of |
| 11 | the project, the estimated proposal development costs, and the |
| 12 | anticipated degree of competition during the procurement |
| 13 | process. Stipends shall be used to encourage competition and |
| 14 | compensate only the shortlisted firms that unsuccessfully |
| 15 | submitted proposals for a portion of their proposal development |
| 16 | costs. The department shall be able to use ideas from firms that |
| 17 | were unsuccessful in their submission of a proposal and that |
| 18 | have accepted a stipend under this subsection. |
| 19 | (6) The department shall adopt rules pursuant to chapter |
