The Committee on Education Pre-K - 12 (Gaetz) recommended the

following amendment:

and insert:

(4)(a) Upon notification that one or more of the conditions in

8

subsection (1) exist, the charter school sponsor or the

9

sponsor's designee and the Commissioner of Education shall

10

contact the charter school governing body to determine what

11

actions have been taken by the charter school governing body to

12

resolve the condition. The Commissioner of Education charter

13

school sponsor has the authority to require and approve a

14

financial recovery plan, to be prepared by the charter school

15

governing body, prescribing actions that will cause the charter

16

school to no longer be subject to this section. The Department

17

of Education shall establish guidelines for developing such

18

plans.

     (b) Upon notification that one or more of the conditions

20

in subsection (1) exist, the charter technical career center

21

sponsor or the sponsor's designee and the Commissioner of

22

Education shall contact the charter technical career center

23

governing body to determine what actions have been taken by the

24

charter technical career center governing body to resolve the

25

condition. The Commissioner of Education may require and approve

26

a financial recovery plan, to be prepared by the charter

27

technical career center governing body, prescribing actions that

28

will cause the charter technical career center to no longer be

29

subject to this section.

(c) The Commissioner of Education shall determine if the

31

charter school or charter technical career center needs a

32

financial recovery plan to resolve the condition. If the

33

Commissioner of Education determines that a financial recovery

34

plan is needed, the charter school or charter technical career

35

center is considered to be in a state of financial emergency.
