Section 14. Subsection (2) of section 1001.364, Florida
8
Statutes, is amended to read:
9
1001.364 Alternate procedure for election of district
10
school board chair.--
11
(2) A proposition calling for the district school board
12
chair to be elected by districtwide vote shall be submitted to
13
the electors of the school district at any primary, general, or
14
otherwise-called special election in either of the following
15
manners:
16
(a) The district school board may adopt a formal resolution
17
directing that the proposition be placed on the ballot; or
18
(b) The electors of the school district may petition to
19
have the proposition placed on the ballot by presenting to the
20
district school board petitions signed by not less than 10
21
percent of the duly qualified electors residing within the school
22
district. The number of signatures required shall be determined
23
by the supervisor of elections according to the number of
24
registered electors in the school district as of the date the
25
petitioning electors register as a political committee as
26
provided in subsection (3).

Such an election may not be held before January 1, 2009.

Section 15. Task force on elected school board
30
chairs.--There is created the Task Force on Elected School Board
31
Chairs.

(1) The members of the task force shall consist of the
33
following eight members:
34
(a) Five members appointed by the Governor, of which one
35
shall be an elected school board member representing a single-
36
member district, one shall be an appointed superintendent of
37
schools, one shall be a member of a parent-teacher organization,
38
and two shall be members of an organization interested in
39
enforcement of the Federal Voting Rights Act. The Governor shall
40
designate one of his or her appointees as the chair.
41
(b) One member who is a senator appointed by the President
42
of the Senate, who shall serve as an ex officio, non-voting
43
member.
44
(c) On member who is a representative appointed by the
45
Speaker of the House of Representatives, who shall serve as an ex
46
officio, non-voting member.

(d) The Secretary of Education, or his or her designee, who
48
shall serve as an ex officio, nonvoting member.

(2) The task force shall convene its initial meeting by
50
September 1, 2008, and thereafter at the call of its chair. Task
51
Force members may not receive remuneration for their services,
52
but are entitled to reimbursement by the Legislative Committee on
53
Intergovernmental Relations for travel and per diem expenses in
54
accordance with s. 112.061, Florida Statutes.
55
(3) The Legislative Committee on Intergovernmental
56
Relations shall serve as staff to the task force.
57
(4) All state agencies and local governments are directed
58
to cooperate with and assist the task force to the fullest extent
59
possible.

(5) The task force shall act as an advisory board to the
61
Governor and the Legislature. The task force shall examine the
62
effects of a county-wide elected chair of the school board,
63
including the effects on school board governance and legal issues
64
related to the implementation of ss. 1001.364 and 1001.365,
65
Florida Statutes. The task force shall submit a report on its
66
recommendations to the Governor, the President of the Senate, and
67
the Speaker of the House of Representatives on or before February
68
1, 2009.

(6) The task force shall expire February 28, 2009.
