          Section 2.  Subsection(3) of section 559.928, Florida

8

Statutes, are amended to read:

     559.928  Registration.--

10

          (3)  Each independent agent shall annually file an

11

affidavit with the department prior to engaging in business in

12

this state. This affidavit must include the independent agent's

13

full name, legal business or trade name, mailing address,

14

business address, telephone number, social security number, and

15

the name or names and addresses of each seller of travel

16

represented by the independent agent. A letter evidencing proof

17

of filing must be issued by the department and must be

18

prominently displayed in the independent agent's primary place

19

of business. Each independent agent must also submit an annual

20

registration fee of $15. All amounts collected shall be

21

deposited by the Chief Financial Officer to the credit of the

22

General Inspection Trust fund of the Department of Agriculture

23

and Consumer Services pursuant to s. 570.20, for the sole

24

purpose of administration of this part. As used in this

25

subsection, the term "independent agent" means a person who

26

represents a seller of travel by soliciting persons on its

27

behalf; who has a written contract with a seller of travel which

28

is operating in compliance with this part and any rules adopted

29

thereunder; who does not receive a fee, commission, or other

30

valuable consideration directly from the purchaser for the

31

seller of travel; who does not at any time have any unissued

32

ticket stock or travel documents in his or her possession; and

33

who does not have the ability to issue tickets, vacation

34

certificates, or any other travel document. The term

35

"independent agent" does not include an affiliate of the seller

36

of travel, as that term is used in s. 559.935(3), or the

37

employees of the seller of travel or of such affiliates.
