9 | (1)(a) The owner and operator of every vessel on the |
10 | waters of this state shall carry, store, maintain, and use |
11 | safety equipment in accordance with current United States Coast |
12 | Guard safety equipment requirements as specified in the Code of |
13 | Federal Regulations, unless expressly exempted by the |
14 | department. |
15 | (b) No person shall operate a recreational vessel less |
16 | than 26 feet in length on the waters of this state unless every |
17 | person under 13 6 years of age on board the vessel is wearing a |
18 | type I, type II, or type III Coast Guard approved personal |
19 | flotation device or is located below deck or in an enclosed |
20 | cabin while such vessel is underway. For the purpose of this |
21 | section, "underway" shall mean at all times except when a vessel |
22 | is anchored, moored, made fast to the shore, or aground. |
23 | (c) No person shall use a recreational vessel on the |
24 | waters of this state unless at least one type I, type II, or |
25 | type III Coast Guard approved personal flotation device is on |
26 | board for each person. Recreational vessels 16 feet or more in |
27 | length shall have at least one type IV Coast Guard approved |
28 | personal flotation device on board in addition to the |
29 | requirements of this paragraph. |
