3     Amendment to Amendment (442261)
4     Remove lines 166-194 and insert:
5(e)  A school district that terminates its program under
6paragraph (d) shall contract with a provider selected and
7approved by the department for the provision of virtual
8instruction until the school district receives approval from the
9department to operate a new school district virtual instruction
10program.
11     (f)  A school district virtual instruction program must
12have a sufficient number of students enrolled in each grade for
13a grade to be assigned to the program pursuant to s. 1008.34 and
14State Board of Education rule.
15     (9)  EXCEPTIONS.--A provider of digital or online content
16or curriculum that is used to supplement the instruction of
17students who are not enrolled in a virtual instruction program
18under this section is not required to meet the requirements of
19this section.
20     (10)  MARKETING.--Any information provided by a school
21district to parents and students regarding the school district's
22virtual instruction program must include information about
23opportunities available at, and the parent's and student's right
24to access courses offered by, the Florida Virtual School under
25s. 1002.37.
26     (11)  2008-2009 SCHOOL DISTRICT VIRTUAL INSTRUCTION
27PROGRAM.--For the 2008-2009 school year, each school district in
28the state may offer a school district virtual instruction
29program to provide full-time virtual courses in kindergarten
30through grade 8 or to provide full-time or part-time virtual
31courses in grades 9 through 12 as authorized in paragraph
32(7)(c). Such program may be operated or contracted as provided
33under paragraph (1)(b) and must comply with all requirements of
34this section, except that contracts under this subsection may
35only be issued for virtual courses in kindergarten through grade
368 to providers operating under s. 1002.415 or for virtual
37courses in grades 9 through 12 as authorized under paragraph
38(7)(c) to providers who contracted with a regional consortium in
39the 2007-2008 school year to provide such services.
