| 6 | (5) ELIGIBILITY.--Eligibility to enroll in an approved |
| 7 | health flex plan is limited to residents of this state who: |
| 8 | (a)1. Are 64 years of age or younger; |
| 9 | 2.(b) Have a family income equal to or less than 300200 |
| 10 | percent of the federal poverty level; |
| 11 | (c) Are eligible under a federally approved Medicaid |
| 12 | demonstration waiver and reside in Palm Beach County or Miami- |
| 13 | Dade County; |
| 14 | 3. (d) Are not covered by a private insurance policy and |
| 15 | are not eligible for coverage through a public health insurance |
| 16 | program, such as Medicare or Medicaid, unless specifically |
| 17 | authorized under paragraph (c), or another public health care |
| 18 | program, such as Kidcare, and have not been covered at any time |
| 19 | during the past 6 months, except that: |
| 20 | a. A person who was covered under an individual health |
| 21 | maintenance contract issued by a health maintenance organization |
| 22 | licensed under part I of chapter 641 that also was an approved |
| 23 | health flex plan on October 1, 2008, may apply for coverage in |
| 24 | the same health maintenance organization's health flex plan |
| 25 | without a lapse in coverage if all other eligibility |
| 26 | requirements are met; or |
| 27 | b. A person who was covered under Medicaid or Kidcare and |
| 28 | lost eligibility for the Medicaid or Kidcare subsidy due to |
| 29 | income restrictions within 90 days prior to applying for health |
| 30 | care coverage through an approved health flex plan may apply for |
| 31 | coverage in a health flex plan without a lapse in coverage if |
| 32 | all other eligibility requirements are met; and |
| 33 | 4.(e) Have applied for health care coverage as an |
| 34 | individual through an approved health flex plan and have agreed |
| 35 | to make any payments required for participation, including |
| 36 | periodic payments or payments due at the time health care |
| 37 | services are provided; or |
| 38 | (b) Are part of an employer group at least 75 percent of |
| 39 | the employees of which have a family income equal to or less |
| 40 | than 300 percent of the federal poverty level and which employee |
| 41 | group is not covered by a private health insurance policy and |
| 42 | has not been covered at any time during the past 6 months. If |
| 43 | the health flex plan entity is a health insurer, health plan, or |
| 44 | health maintenance organization licensed under Florida law, only |
| 45 | 50 percent of the employees must meet the income requirements |
| 46 | for the purpose of this paragraph. |
| 47 | (10) EXPIRATION.--This section expires July 1, 2013 2008. |
