5 | Between lines 558 and 559, insert: |
6 | Section 14. In order to implement Specific Appropriation |
7 | 236 of the 2008-2009 General Appropriations Act, the Agency for |
8 | Health Care Administration shall study the effects of the |
9 | minimum nursing home staffing ratios found in s. 400.23(3), |
10 | Florida Statutes, and the relationship to Medicaid reimbursement |
11 | and the quality of care provided to residents. The agency shall |
12 | report its findings to the Governor, the President of the |
13 | Senate, and the Speaker of the House of Representatives by |
14 | February 1, 2009. Until July 1, 2009, failure to meet the |
15 | staffing ratios pursuant to s. 400.23(3), Florida Statutes, |
16 | failure to impose a moratorium on new admissions pursuant to s. |
17 | 400.141(15)(d), Florida Statutes, or failure to comply with the |
18 | staffing ratios pursuant to s. 400.141(15)(e) and (f), Florida |
19 | Statutes, shall not constitute a deficiency as long as the |
20 | certified nursing assistant ratio is not below 2.6 hours per |
21 | resident per day and the licensed nurse ratio is not below 1.0 |
22 | hours per resident per day. This section expires July 1, 2009. |
