| 5 | Section 61. Section 372.85, Florida Statutes, is |
| 6 | renumbered as section 379.29, Florida Statutes, to read: |
| 7 | 379.29 372.85 Contaminating fresh waters.-- |
| 8 | (1) It shall be unlawful for any person or persons, firm |
| 9 | or corporation to cause any dyestuff, coal tar, oil, sawdust, |
| 10 | poison, or deleterious substances to be thrown, run, or drained |
| 11 | into any of the fresh running waters of this state in quantities |
| 12 | sufficient to injure, stupefy, or kill fish which may inhabit |
| 13 | the same at or below the point where any such substances are |
| 14 | discharged, or caused to flow or be thrown into such waters; |
| 15 | provided, that it shall not be a violation of this section for |
| 16 | any person, firm, or corporation engaged in any mining industry |
| 17 | to cause any water handled or used in any branch of such |
| 18 | industry to be discharged on the surface of land where such |
| 19 | industry or branch thereof is being carried on under such |
| 20 | precautionary measures as shall be approved by the Fish and |
| 21 | Wildlife Conservation Commission. |
| 22 | (2) Any person, firm or corporation violating any of the |
| 23 | provisions of this section shall be guilty of a misdemeanor of |
| 24 | the second degree, punishable as provided in s. 775.082 or s. |
| 25 | 775.083 for the first offense, and for the second or subsequent |
| 26 | offense shall be guilty of a misdemeanor of the first degree, |
| 27 | punishable as provided in s. 775.082 or s. 775.083. |
